13.09.010 Purpose.

The purpose of this chapter is to conserve water by requiring the installation of ultra-low flow toilets and to provide relief to the city wastewater treatment facility by reducing the amount of wastewater requiring treatment. (Ord. 90-18 N.S. § 1, 1990).

13.09.020 Definitions.

A. “Approved ultra-low flow toilet” means a water closet, flush toilet or urinal together with associated flushometer valves, if any, which use no more than 1.6 gallons per flush.

B. “Bathroom” means any room or area within a structure where a flush toilet or urinal exists or is to be constructed.

C. “New construction” means (1) the construction of any previously nonexistent residential, commercial or industrial structure in which a bathroom is required or placed; (2) the remodel of an existing bathroom; (3) the construction of a new bathroom within an existing structure; or (4) the increase in floor area of an existing structure in excess of 25 percent measured from the exterior of all exterior walls. 13.09.030 Requirement of approved ultra-low flow toilets for new construction.

Except as provided in BMC 13.09.040, approved ultra-low flow toilets shall be installed in all new construction within the city and all existing unapproved flush toilets and urinals shall be removed. No building permit shall be issued for new construction which does not provide for the installation of approved ultra-low flow toilets. (Ord. 90-18 N.S. § 1, 1990).

13.09.040 Exceptions.

Where application is made to the public works department director in writing by an owner requesting an exception to BMC 13.09.030, the use of standard flush toilets or urinals may be permitted if the director finds in writing based upon substantial evidence that either (A) during the period of construction no approved ultra-low flow toilets are available or (B) the configuration of the building drainage system requires a greater quantity of water than is generated by ultra-low flow toilets to adequately flush the system. (Ord. 90-18 N.S. § 1, 1990).

13.09.050 Responsibility for enforcement.

The city building inspection division shall have the responsibility for (A) approving any flush toilet to be installed as required by BMC 13.09.030 and certifying that said toilet is an approved ultra-low flow toilet; (B) approving building permits for new construction which provide for the installation of approved ultra-low flow toilets; and (C) inspecting all new construction to assure that required ultra-low flow toilets have been installed.
