10.05.010 Findings and purpose.

The city council hereby finds that the parking of commercial motor vehicles on streets and in the public right-of-way in areas zoned for residential use is detrimental and hazardous to residents in such areas and declares that the purpose of this chapter is to reduce or prevent commercial motor vehicle accidents, fatalities and injuries. 10.05.020 Definitions.

Except where the context requires a different meaning, the definitions given in this section shall govern the construction of this chapter.

“Commercial vehicle” shall mean a vehicle used or maintained for the transportation of persons for hire, compensation, or profit or designed, used, or maintained primarily for the transportation of property.

“Trailer” shall mean a vehicle, other than a motor vehicle, designed and used for human habitation or human occupancy for industrial, professional or commercial purposes, or designed for carrying persons or property, on its own structure, and for being drawn by a motor vehicle; “trailer” includes a semi-trailer when used in conjunction with an auxiliary dolly, if the auxiliary is of a type constructed to replace the function of the drawbar and the front axle or axles of a trailer.

“Truck tractor” shall mean a motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn. [Ord. 295 § 4, 2010; Ord. 93-12 § 1; Code 1990 § 3.8.02.]

10.05.030 Parking prohibitions for certain vehicles and places.

A. Except as provided in CMC 10.05.040, no person shall park or leave standing on any street or within any public right-of-way in an area zoned for residential use any commercial vehicle having a manufacturer’s gross weight rating of 10,000 pounds or more, any commercial trailer, or any truck tractor with or without an attached trailer or semi-trailer.

B. No person shall park or leave standing any vehicle which is six feet or more in height, including any load thereon, within 100 feet of any street intersection or official traffic control device within the city.

C. No person shall park or leave standing within 75 feet of any driveway opening in the city any commercial vehicle, any commercial trailer, or any truck tractor with or without an attached trailer or semi-trailer.

D. No person shall park or leave standing on any street or public right-of-way within the city any vehicle which contains any hazardous substance as described in Section 2452 of the California Vehicle Code.

E. No person shall park or leave standing on any street or public right-of-way within the city any trailer or semi-trailer.

F. No person shall park or leave standing any vehicle in an alley within the city or on the paved portion of any public thoroughfare having a paved width of 20 feet or less. [Ord. 295 §§ 5, 6, 2010; Ord. 93-12 § 1; Code 1990 § 3.8.03.]

10.05.040 Exceptions.

A. The prohibitions and restrictions set forth in CMC 10.05.030(A) shall not be effective during the first 24 hours while a vehicle is mechanically disabled, or with respect to any commercial vehicle making pickups or deliveries of goods, wares, and merchandise from or to any building or structure located in a residential zone or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure located in a residential zone for which a building permit has previously been obtained.

B. Repealed by Ord. 295.

C. The prohibitions and restrictions set forth in CMC 10.05.030(A) shall not be construed to apply to emergency vehicles responding to an actual emergency, or to vehicles owned and operated by any public utility while being used in connection with any bona fide service call, repair, alteration, remodeling or construction. 10.05.050 Posting of notice of restriction.

The city manager, or his designated representative, shall post or cause to be posted appropriate signs or devices giving notice of the parking prohibitions and restrictions created by this chapter. [Ord. 93-12 § 1; Code 1990 § 3.8.05.]

10.05.060 Penalties.

Penalties for violation of this chapter shall be determined by resolution of the city council from time to time and shall include administrative fees, service of process fees, fees and collection costs related to civil debt collection, penalties and costs imposed by the county of Riverside for jail and courthouse construction, and other related charges.
