1.01.010 Findings and intent.
The City Council finds and declares that:
A. On December 6, 1994, the City Council adopted Ordinance No. 506. By such action, the City Council adopted by reference the amended City of Calistoga Municipal Code, together with these secondary codes adopted and incorporated by reference as authorized by the California State Legislature.
B. The City Council desires to amend, recodify and correct minor errors in the existing ordinances comprising the City of Calistoga Municipal Code as of January 6, 2004 (through Ordinance No. 594).
C. In enacting the ordinance codified in this chapter, the City Council has complied with the procedural requirements of California Government Code Section 50022.1 et seq. As part of such compliance, there has been filed in the office of the City Clerk for public inspection a copy of the City of Calistoga Municipal Code, together with a copy of each of the secondary codes therein adopted by reference. 1.01.020 Recodification and adoption of the code.
The City of Calistoga Municipal Code, as amended as of January 6, 2004 (through Ordinance No. 594), is hereby amended and recodified to read as set forth in that certain document entitled “City of Calistoga Municipal Code (2003 Edition)” and published by Code Publishing Company. The City of Calistoga Municipal Code (2003 Edition), and the secondary codes duly described therein, are adopted by reference pursuant to California Government Code Section 50022.1 et seq. (Ord. 598 § 2, 2004).
1.01.030 Continuation of existing law.
Where substantially the same as existing law, the City of Calistoga Municipal Code (2003 Edition) shall be considered a continuation of existing law and not a new enactment. (Ord. 598 § 3, 2004).

1.01.050 Validity of Municipal Code.
If any section or portion of this chapter is for any reason held to be invalid and/or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this chapter. (Ord. 598 § 5, 2004).
1.01.060 Publication of ordinance.
The ordinance codified in this chapter shall be published in accordance with Government Code Section 36933 by either posting or publishing the ordinance in accordance with that law. (Ord. 598 § 6, 2004).
1.01.070 Ordinance effective date.
The ordinance codified in this chapter shall be effective 30 days after final adoption. (Ord. 598 § 7, 2004).
