EMERGENCY CURFEWS*

2.68.010 Definitions.
For the purposes of this chapter, the words shall have the meanings stated as follows:
A. “Curfew” means a period of time between the hour of sunset and the hour of sunrise during which no person shall be in or upon any public place or street unless the person is engaged in an essential public function or private emergency.
B. “Emergency” means unforeseen circumstances which demand immediate action for the preservation of the public welfare and safety, including periods of violent disturbance of the peace, as well as civil disobedience, civil uprising and riot which cause or threaten to cause loss of life or property within the City. (Ord. 148 C.S. § 1, 1967; Code 1975 § 696.2).
2.68.020 Mayoral Power.
During conditions of emergency and upon the recommendation of the Chief of Police, the Mayor may, by proclamation distributed to local news media, declare a temporary curfew during any or all hours of darkness and within any or all parts of the City. (Ord. 148 C.S. § 1, 1967; Code 1975 § 696.0).
2.68.030 Termination.
Any curfew proclaimed by the Mayor, as provided in CMC 2.68.020, shall be terminated by the Mayor on the recommendation of the Chief of Police or may be terminated by action of the City Council at any meeting. (Ord. 148 C.S. § 1, 1967; Code 1975 § 696.1).
