13.64.010 Findings and purpose.

The city of Cotati’s projected future population growth has led to increased concern over the city’s diminishing sewage treatment capacity share in the Santa Rosa subregional sewerage system. At the same time, the city depends on the use of a ground water supply and the use of Russian River water supplied by the Sonoma County water agency for the city’s water supply and wishes to conserve those finite resources.

Therefore, the city council of Cotati determines that there are certain water savings devices and indoor water conservation measures which can be incorporated into all new construction, and in remodeling of existing kitchens and bathrooms, and that the use of such devices and implementation of such indoor water conservation measures will help conserve water and preserve the city’s sewerage treatment capacity. 13.64.020 Scope of provisions.

The provisions of this chapter shall apply to all new construction and remodeling, when any building permit is issued after the effective date of the ordinance codified in this chapter. (Ord. 521 § 2, 1989).

13.64.030 Conservation devices – Required for building permit.

A. All tank-type water closets in any and all new construction and any project involving remodel of a bathroom(s) shall use 1.28 gallons per flush or less and conform to the U.S. Environmental Protection Agency Water Sense specifications, as demonstrated through Water Sense product labeling.

B. In all new construction, and any construction project involving the remodeling of bathrooms, kitchens, laundry rooms or other areas where hot water piping is installed, potable hot water piping in accessible unconditioned areas leading from water heaters shall be insulated to provide an installed conductance of 0.33 or less.

C. A water/wastewater conservation fee is hereby established and shall be consistent with Section 13.64.010 and as follows:

1. The water/wastewater fee shall apply to all new or increased (in number or size) sewer or water connections for residential and nonresidential property.

2. The amount of the water/wastewater conservation fee shall be established by resolution of the city council and shall be amended from time to time to appropriately reflect cost changes. (Ord. 822 § 1, 2009: Ord. 811 § 2, 2007: Ord. 610 § 1, 1993: Ord. 521 § 3, 1989).

13.64.050 Variances.

In order to prevent or lessen unnecessary hardship or practical difficulties in exceptional cases, aggrieved persons may file a written application for a variance with the building department for subsequent action by the city council. The city council may grant such variance only when unusual hardship will result from the strict application of this chapter. (Ord. 521 § 5, 1989).
