UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING

5.06.010 Purpose.
The City has elected to become subject to the uniform public construction accounting procedures set forth in the California Uniform Public Construction Cost Accounting Act (Cal. Pub. Cont. Code § 22000 et seq.). The bidding procedures set forth in this chapter are enacted pursuant to Cal. Pub. Cont. Code § 22034. [Ord. 16-002 § 2.]
5.06.020 Public projects.
A. Public projects, as defined in Cal. Pub. Cont. Code § 22002, of forty-five thousand dollars ($45,000.00) or less may be performed by City staff, negotiated contract, or by purchase order.
B. Public projects of one hundred seventy-five thousand dollars ($175,000.00) or less may be let to contract by informal procedures as set forth in Cal. Pub. Cont. Code § 22032 et seq.
C. Public projects of more than one hundred seventy-five thousand dollars ($175,000.00) shall be let to contract by formal bidding procedure. [Ord. 16-002 § 2.]
5.06.030 Contractors list.
A list of contractors, identified according to categories of work, shall be developed and maintained in accordance with the provisions of Cal. Pub. Cont. Code § 22034 and criteria promulgated from time to time by the California Uniform Construction Cost Accounting Commission. [Ord. 16-002 § 2.]
5.06.040 Notice inviting informal bids.
A. Where a public project is to be performed which is subject to the provisions of this chapter, a notice inviting informal bids shall be mailed to all contractors for the category of work to be bid as shown on the list developed in accordance with DMC 5.06.030, and/or to all construction trade journals as specified by the California Uniform Construction Cost Accounting Commission in accordance with Cal. Pub. Cont. Code § 22036. Provided, however, that if the product or service is proprietary in nature such that it can be obtained from a certain contractor or contractors, the notice inviting informal bids may be sent exclusively to such contractor or contractors.
B. The notice inviting informal bids shall describe the project in general terms, how to obtain more detailed information about the project, and state the time and place for the submission of bids.
C. All mailing of notices to contractors and/or construction trade journals shall be completed not less than ten (10) calendar days before bids are due. For the purpose of this section, “mailing” shall include delivery by the United States Postal Service or equivalent delivery services, electronic facsimile transmissions, or personal service. 5.06.050 Informal bids in excess of one hundred seventy-five thousand dollars ($175,000.00).
If all informal bids received are in excess of one hundred seventy-five thousand dollars ($175,000.00), the City Council may, by passage of a resolution by a four-fifths vote, award the contract, at one hundred eighty-seven thousand five hundred dollars ($187,500.00) or less, to the lowest responsible bidder, if it determines the cost estimate of the public agency was reasonable.
