SPECIFIC PLAN (SP) OVERLAY DISTRICT

18.10.030 Adopted specific plans.
18.10.010 Purpose.
The purpose of this chapter is to identify all of the adopted specific plans that apply in the City and reference the regulations that apply. [Ord. 24-002 § 5 (Exh. A).]
18.10.020 Applicability.
The provisions of this chapter apply to all areas within plan boundaries of specific plans adopted by the City.
A. Adopted Specific Plans. Once adopted, a specific plan shall govern the use and development of properties within the bounds of that specific plan.
1. Where a specific plan is silent regarding development standards, the provisions of this code shall govern. The Community Development Director shall have the authority to determine which provisions of this code apply where a specific plan is silent.
2. When a use is not specifically listed as permitted in the specific plan, the Director shall assign the land use or activity to a classification that is substantially similar in character. The decision of the Director in such instances may be appealed under DMC 18.21.120, Appeals. The Director may refer any request for determination of use classification that is unclear, may generate substantial public controversy, or involve significant land use policy decisions to the Planning Commission for decision. Land uses not listed in the specific plan as permitted or not found to be substantially like a permitted use are prohibited.
3. No discretionary entitlement applications or other permits may be approved, adopted, or amended within an area covered by a specific plan, unless found to be consistent with the adopted specific plan. [Ord. 24-002 § 5 (Exh. A).]
18.10.030 Adopted specific plans.
The following is a list of the City’s adopted specific plans:
A. Northeast Quadrant Specific Plan. See the Northeast Quadrant specific plan on file with the City.
