10.44.010 Defined.
“Bicycle” means any device upon which a person may ride, which is propelled by human power through a system of belts, chains, or gears having either two or three wheels, one of which is at least 20 inches in diameter, in tandem or tricycle arrangement or having a frame size of at least 14 inches. (Ord. 78-400 § 1).
10.44.020 License – Required.
Any person residing in the city and owning a bicycle must register that bicycle with and purchase a license from the police department within 10 days of acquiring the bicycle. If required by the police department, the owner must at this time present the bicycle for inspection. Renewal of license shall be done within 10 days of expiration. (Ord. 78-400 § 2).
10.44.030 License – Display.
Upon approval of the application and payment of the license fee, a license will be issued. The license shall be affixed to the front of the seat tube of the bicycle frame. (Ord. 78-400 § 3).
10.44.040 Transfer of ownership.
A. Whenever an owner sells or otherwise disposes of a bicycle, he shall endorse upon the registration certificate previously issued for such bicycle a written transfer of same, completing all information as prescribed on the registration form. The transferror shall then deliver the registration certificate, so endorsed, to the licensing agency within 10 days.
B. Any person who purchases or otherwise acquires possession of a bicycle and is a resident of the city shall, within 10 days of taking possession, apply for the transfer of license to his own name. (Ord. 78-400 § 4).
10.44.050 Address change.
An owner of a registered bicycle shall inform the police department of a change of address within 10 days of the change. (Ord. 78-400 § 5).
10.44.060 Reporting loss or theft.
Whenever a bicycle is lost or stolen it should be reported to the police department as soon as practical. (Ord. 78-400 § 6).
10.44.070 Dismantling.
Within 10 days after any registered bicycle is dismantled or taken out of operation, such information shall be reported to the police department. Upon dismantling a bicycle, the licensee shall surrender his license to the police department. (Ord. 78-400 § 7).
10.44.080 Destruction or mutilation of license or serial number prohibited.
No person shall willfully remove, destroy, mutilate, or alter either the license or the manufacturer’s serial number. (Ord. 78-400 § 8).
10.44.090 Penalty for violation.
The police department may impound and retain possession of any bicycle in violation of this chapter and may retain possession of such bicycle until the provisions of this chapter are complied with. In addition, a fine may be imposed for any violation of this chapter. No fine imposed for any violation of this chapter or any resolution adopted pursuant to this chapter shall exceed $5.00. 10.44.100 Disposition of funds.
All fees and fines collected under this chapter shall be deposited with the city treasurer to the credit of the city general fund. The fund shall be used to implement and improve bicycle registration and safety. (Ord. 78-400 § 10).
10.44.110 Applicability to motorized bicycles.
The provisions of this chapter are applicable to motorized bicycles. (Ord. 78-400 § 11).
