8.08.010 Adoption of the County Fire Code.
Subject to the particular additions, amendments and deletions set forth in this chapter, the city of Gardena hereby adopts the most current version of the Los Angeles County Fire Code by reference. (Measure A § 5, adopted March 2, 1999, amended August 26, 2003)
8.08.020 Los Angeles County Fire Code version.
Pursuant to Section 8.08.010, which requires the city to adopt the latest version of the Los Angeles County Fire Code by reference, the version of the Los Angeles County Fire Code for the city shall be the version of Title 32 of the Los Angeles County Code as set forth in Ordinance No. 2023-0008 adopted by the Los Angeles County board of supervisors on March 2, 2023. 8.08.030 Fire fighting, EMS services and hazardous materials.
A. Responsibility for providing fire protection, EMS services, and protection from hazardous materials in the city of Gardena is hereby transferred from the Gardena Fire Department to the Los Angeles County Fire Department subject to the provisions of this section.
B. The Gardena city council shall take all necessary steps to carry out the provisions of subsection A of this section. All actions taken by the Gardena city council shall be in the manner authorized by California Government Code Section 55632 and provided for by California Government Code Section 56848.3.
C. The transfer of fire fighting and EMS services from the Gardena fire department to the Los Angeles County Fire Department shall take place on the effective date of annexation as determined by the Board of Supervisors in coordination with the Los Angeles County Fire Department and the City of Gardena.
D. At the conclusion of a twelve-month period following the transfer of fire fighting and EMS services from the Gardena fire department to the Los Angeles County Fire Department, the Gardena city council shall undertake a review with respect to the performance of fire fighting and EMS services. In addition, the review shall examine any cost savings to the city of Gardena which have occurred.
E. Any savings realized as a result of the transfer of fire fighting and EMS services from the Gardena fire department to the Los Angeles County Fire Department which occur shall be used to balance the city budget and prevent city employee layoffs.
F. Once the transfer of fire fighting and EMS services from the Gardena Fire Department to the Los Angeles County Fire Department occurs, any city general fund monies that were previously utilized to pay fire fighter pensions shall be used to balance the city budget and prevent city employee layoffs. 8.08.035 Amendment of Section 7802.3.
Section 7802.3 of the Uniform Fire Code as adopted by Section 8.08.010 is amended to read as follows:
Section 7802.3. Except as provided in Chapter 8.16 of Title 8 of this code, the storage, use and handling of fireworks are prohibited.
Any provision of the Uniform Fire Code or of any subsequent revised edition of the Uniform Fire Code, related to prohibiting the storage, sale, handling and discharge of fireworks, as adopted in accordance with Section 8.08.010, is hereby amended to add an exception for safe and sane fireworks which shall be regulated in accordance with Chapter 8.16, as that Chapter 8.16 may from time to time be amended by the city council to regulate, but not prohibit, the storage, sale, handling, and discharge of safe and sane fireworks in the city. 8.08.040 Fire fighter contract.
Notwithstanding any other provision of the Gardena Municipal Code, in the event that fire fighting and EMS services are transferred from the Gardena Fire Department to the Los Angeles County Fire Department, any contract entered into between the City and the Los Angeles County Fire Department shall include all necessary or appropriate provisions relating to salary and fringe benefits, medical benefits, and retirement benefits for fire fighters.
