STREET IMPROVEMENT STANDARDS

14.12.010 City engineer certification.
Prior to the issuance of a building permit for the construction of any main residential or commercial building on a parcel, or of any addition adding twenty-five percent or more square footage to such a building, the city engineer shall certify that the building site is adjacent to and served by streets that are improved to city standards. (Ord. 11-88 §2(part), 1988).
14.12.020 Procedure for partially improved streets.
A building permit for construction as defined in Section 14.12.010 where the building site is located adjacent to a partially improved street, may be issued when the following conditions are met:
A. The street was partially improved as of the effective date of this ordinance codified in this chapter;
B. The city engineer determines that the street is capable of safe and adequate access by emergency vehicles;
C. An agreement to install full street improvements in accordance with Section 14.12.040 is executed by the applicant and recorded with the county recorder. (Ord. 11-88 §2(part), 1988).
14.12.030 Procedure for unimproved streets.
A building permit for construction as defined in Section 14.12.010, where the building site is adjacent to an unimproved street, may be issued when the following conditions are met:
A. The street is unimproved at the time the permit is applied for;
B. The applicant agrees to construct an interim private street to city standards as set by council resolution prior to the building’s occupancy. Said standards may vary from those street standards established under Chapter 14.30 of the Half Moon Bay municipal code;
C. An agreement to install full street improvements in accordance with Section 14.12.040 is executed by the applicant and recorded with the county recorder;
D. Where an applicant applies for a building permit for construction, as defined in Section 14.12.010, where the site is adjacent to an interim private street, previously improved under this Section 14.12.030, the applicant shall be required to execute an agreement as set forth in subsection C of this section, and comply with the terms of subsection. 14.12.040 Agreement to install improvements.
An agreement to install street improvements, as set forth in this chapter shall include the following:
A. The property owner(s) agree to participate in a future assessment district and being assessed his share for the construction of street improvements to city standards;
B. The agreement shall be recorded with the San Mateo County recorder as a lien against the subject property, and shall be binding on any successors in interest to said property. The lien shall be discharged when:
1. The subject property becomes a part of a future assessment district to construct full street improvements;
2. The subject property owner pays in full, with credit for sums paid in advance under the agreement, any assessment levied;
3. The city clerk prepares and delivers to the owner a notice of satisfaction of lien. (Ord. 10-91 §2, 1991).
14.12.050 Trust fund.
Any and all funds collected by the city under this chapter shall be held by the city treasurer in a separate account in a trust fund and applied, upon order of the city council solely to the street improvements (including any reasonable administrative charge and incidental expense) specified in the agreement, or to the reduction of any assessment levied or to be levied upon the parcel in question by an assessment district formed to complete such improvements. Any surplus in any account shall be refunded, without interest and without delay, to the then owner or owners of the property when such surplus is determined by the city council.
