9.08.050 Liability of parents, guardians, etc.
9.08.010 Minors under 18.
It shall be unlawful for any minor person under the age of 18 years to loiter or loaf or to congregate or to remain upon any public street, way, square, park, place, building or at or in any place of business, or business house, or public dance hall within the corporate limits of the City of Healdsburg, or other place designated for the accommodation of the public in said City between the hours of 11:00 p.m. of one day and 5:00 a.m. of the following day. Any person who has not attained his eighteenth birthday shall be deemed to be under the age of 18 years. (Ord. 715 § 1, 1983; Ord. 376 § 1. Code 1964 § 13-2.)
9.08.020 Minors under 16.
It shall be unlawful for any minor person under the age of 16 years to loiter or loaf or to congregate or to remain upon any public street, way, square, park, place, building or at or in any place of business, or business house, or public dance hall within the corporate limits of the City of Healdsburg, or other place designated for the accommodation of the public in said City between the hours of 10:00 p.m. of one day and 5:00 a.m. of the following day. Any person who has not attained his sixteenth birthday shall be deemed to be under the age of 16. (Ord. 715 § 2, 1983; Ord. 376 § 2. Code 1964 § 13-3.)
9.08.030 Exceptions to HMC 9.08.010 and 9.08.020.
The provisions of HMC 9.08.010 and 9.08.020 shall not apply to the following:
A. Any minor who at the time mentioned is accompanied by his parent, guardian or other adult person having the lawful custody of such minor.
B. Any public theaters and places where supervised entertainment, play or instruction for minors under the age of 18 is conducted; provided, however, that this exception shall apply only to minors who are in attendance at such theaters or places for the purpose of attending the supervised entertainment, play or instruction hereby afforded.
C. Any minor while engaged in going or returning from, in direct route, the places mentioned in subsection (B) of this section and his home or other place of abode; provided, however, in the event such minor stops, loiters, loafs, congregates or deviates from such direct route this exception shall not apply.
D. Any minor who is lawfully employed, or to such a minor while engaged in going to or returning from his place of employment in a direct route between such place of employment and his place of abode.
E. Any minor who is performing an emergency errand, when requested to do so by his parent, guardian, or other adult person having the lawful custody of such minor. (Ord. 715 § 3, 1983; Ord. 376 § 6. Code 1964 § 13-4.)
9.08.040 Enforcement.
Any minor violating the provisions of this chapter may be immediately apprehended and lawfully detained and appropriate proceedings may be instituted under and pursuant to the provisions of the juvenile court law as set forth in the Welfare and Institutions Code of the State. 9.08.050 Liability of parents, guardians, etc.
It shall be unlawful for any parent, guardian, or other adult person having the lawful custody, permanent or temporary, of any minor person to suffer, permit or let, either willfully or negligently, such minor violate the provisions of HMC 9.08.010 and 9.08.020. (Ord. 376 § 9. Code 1964 § 13-6.)
