10.04.010 Definitions.

A.    The following words and phrases when used in this title shall for the purpose of this title have the meanings respectively ascribed to them in this section.

B.    Whenever any words or phrases used in this title are not defined in this section, but are now defined in the Vehicle Code of this state, such definitions are incorporated in this section and are deemed to apply to such words and phrases used in this title as though set forth in this section in full.

“Holidays” means legal holidays as established by the laws of the state.

“Loading zone” means the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.

Official Time Standard. Whenever certain hours are named in this title, they mean standard time or daylight saving time as may be in current use in this city.

“Park” means to stand or leave standing any vehicle, whether occupied or not, otherwise than temporarily for the purpose of, and while actually engaged in, loading or unloading of passengers or materials.

“Parkway” means that portion of a street other than a roadway or a sidewalk.

“Passenger loading zone” means the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers.

“Pedestrian” means any person afoot.

“Person” means every natural person, firm, copartnership, association or corporation.

“Stop,” when required, means complete cessation of movement.

“Stop,” or “stand,” when prohibited, means any stopping or standing of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic-control device.

“Through street,” as used in this title, is a street or portion thereof at the entrance to which vehicles or traffic from intersecting streets is required by this title to stop before entering or crossing the same, and when stop signs are erected as provided in this title.

“Traffic” means pedestrians, ridden or herded animals, vehicles and other conveyances either singly or together while using any street for purpose of travel. (Ord. 795 §1, 1998; Ord. 356 Art. I, 1958)

10.04.020 Exemptions from provisions.

A.    The provisions of this title regulating the operations, parking and standing of vehicles, shall not apply to any vehicle of the police, or to fire department, any public ambulance, or any public utility vehicle, or private ambulance, which public utility vehicle or private ambulance has qualified as an authorized emergency vehicle, when any vehicle mentioned in this section is operated in the manner specified in the Vehicle Code of the state in response to an emergency call.

B.    The exemption in subsection A of this section shall not, however, protect the driver of any such vehicle from the consequences of his wilful disregard of the safety of others. (Ord. 356 Art. IX §§1, 2, 1958)

10.04.030 Citation procedure.

Whenever a person is arrested for any violation of this title and he is not immediately taken before a magistrate, the arresting officer shall prepare in triplicate a written notice to appear in court or before a person authorized to receive a deposit of bail, containing the name and address of the person, the license number of his vehicle, if any, the name and address, when available, of the registered owner or lessee of the vehicle, the offense charged and the time and place when and where he shall appear, as provided in Section 40500 of the Vehicle Code of the state, and the proceedings thereafter shall be governed by the provisions of said Section 40500.
