COMMISSIONS, BOARDS AND COMMITTEES GENERALLY:

2-12.1 Absence From Meetings; Removal; Compensation:

a.    Absences From Commission, Board, And Committee Meetings; Removal:

1.    Regardless of other stipulations in legislation or guidelines establishing any boards, commissions or committees, the following policy will be adhered to:

(a)    Three (3) unexcused absences within a calendar year (January—December) shall constitute a vacating of the position for boards, commissions or committees meeting once a month.

(b)    Four (4) unexcused absences within a calendar year (January—December) shall constitute a vacating of the position for boards, commissions or committees meeting twice a month.

(c)    No compensation shall be paid to any board/committee member or commissioner for any meeting in which he/she is absent, whether excused or unexcused.

(d)    Arrival late by fifteen (15) minutes or more to a board, commission or committee meeting shall constitute an unexcused absence and no compensation shall be paid to the commissioner or board or committee member for attending the meeting late.

(e)    In order for the boards’, commissioners’ and committees’ chairmen to appropriately plan for their meetings, any member who has to be absent should notify the chairman of the respective board, commission and committee or, in his/her absence, the staff representative. No more than two (2) excused absences may be permitted within a calendar year (January—December). Board/committee members or commissioners who will not be able to attend a scheduled meeting should properly notify the staff liaison prior to the meeting.

(f)    The city clerk shall send out notices of any vacated seats.

(g)    If any section of this subsection is found to be in conflict with any other section of this code, this section hereby supersedes all other codes.

2.    The city council may remove any member of any commission, board, or committee referred to in subsection 2-12.1a1 of this section at any time and without cause; provided, however, that any action of the city council to remove a member of the personnel board from office prior to the expiration of his term shall not be effective unless approved by at least four (4) councilmen.

b.    Compensation For Members Of Boards And Commissions: Any provision of this code to the contrary notwithstanding, members of city boards and commissions shall be entitled to receive such compensation and reimbursement for expenses as the city council may provide. 2-12.2 Subsidiary Public Bodies:

“Subsidiary public bodies” shall mean city standing advisory commissions, boards, and committees and such other commissions, boards and committees as are established elsewhere in this code. “Subsidiary public bodies” do not include city commissions, boards or committees with memberships consisting solely of members of the city council, city staff or a combination of city council members and city staff. 2-12.3 Membership Of Subsidiary Public Bodies:

Notwithstanding any other provisions to the contrary in this code, the following subsidiary public bodies shall have the number of members as indicated in the table below:

2-12.4 Appointment And Term Of Members:

a.    Candidates for appointment to subsidiary public bodies shall be nominated by a council member and confirmed by a vote of the council. The appointed and confirmed candidates shall serve on the subsidiary public bodies to which they have been appointed until the earlier of:

1.    A replacement is presented to the council for confirmation by the appointing council member;

2.    The appointing council member’s term in office has ended; or

3.    The resignation of an appointee.

b.    Members of subsidiary public bodies shall hold office until their successors are appointed, qualified and take office.

c.    Any and all provisions of this code relating to terms of office for members of subsidiary public bodies are hereby repealed and shall be governed by the provisions of this section. (Ord. #1584, §1)

2-12.5 Additional Membership:

In the event any subsidiary public body is to have more than five (5) members, the city council may, by resolution or motion, designate how many additional members are to be nominated. Any such additional members shall be subject to a confirmation vote by the council, and their terms of office shall be in accordance with the provisions set in subsection 2-12.4 of this section. 2-12.6 Inconsistencies:

Except as otherwise provided for herein, the provisions of this section shall take precedence over and supersede any inconsistent provisions of this code relating to subsidiary public bodies. (Ord. #1584, §1)
