7.25.010 Definition of person.
As used in this chapter, the word “person” means all firms, domestic and foreign corporations, associations, syndicates, partnerships, joint ventures, clubs, Massachusetts, business or common law trusts, societies, and any officer or agent thereof, receiver, trustee, or assignee for the benefit of creditors, and any natural person. 7.25.020 Posting gasoline prices required – Location.
Every person who owns, operates, manages, leases, or rents a place of business which abuts or is adjacent to any street or highway and at which gasoline or other motor vehicle fuel is sold, offered for sale, or otherwise dispensed to the public, shall post or display and maintain at said place of business a sign or other advertising medium clearly visible from each abutting or adjacent street or highway, which indicates or shows the actual price per gallon, including all taxes, at which each grade of gasoline or other motor vehicle fuel is currently being sold, offered for sale, or otherwise dispensed at said place of business. 7.25.030 Advertising price of gasoline or fuel not immediately available prohibited.
No person who owns, operates, manages, leases or rents a place of business at which gasoline or other motor vehicle fuel is sold to the public shall advertise by means of any sign or other advertising medium, the price of any grade of gasoline or other motor vehicle fuel which is not immediately available to be sold or dispensed to the public at said place of business, at said advertised price. (Initiative Ord. No. 343A, § 3; 1976 Code § 7-5.03).
7.25.040 Price changes required to be posted.
No change shall be made in the price of any grade of gasoline or other motor vehicle fuel which is offered for sale, sold or otherwise dispensed to the public at said place of business, without such change being first indicated or shown on a sign or other advertising medium, as required in MMC 7.25.020. (Initiative Ord. No. 343A, § 4; 1976 Code § 7-5.04).
7.25.050 Sign to comply with provisions of Business and Professions Code.
Each sign or other advertising medium posted, displayed and maintained pursuant to the requirements of MMC 7.25.020 shall comply with the provisions of Article 8 of Chapter 7 of Division 8 of the Business and Professions Code of the state, or as hereafter amended. 7.25.060 Size of sign allowed.
In addition to the signs otherwise permitted by the Millbrae Municipal Code, gasoline service stations shall be permitted the following sign: A double-face sign, the size of which shall be four feet by five feet, indicating or showing the actual price per gallon, including all taxes, at which each grade of gasoline or other motor vehicle fuel is currently being sold, offered for sale, or otherwise dispensed at the gasoline service station.
