There is hereby created the position of City Manager. For purposes of this code and resolutions of the City Council, “City Manager” and “City Administrator” may be used interchangeably. (Ord. CCO-02-03, 2002; Ord. CCO-97-03, 1997)
2.50.020 Appointment and removal.
The City Council shall appoint the City Manager and may remove the City Manager by a majority vote. The procedure for removal will be established by contract. In the event there is no contractual procedure for removal, the City Manager may be removed upon 60 days’ written notice. No person elected to membership on the City Council shall, subsequent to such election, be eligible for appointment as City Manager until two years have elapsed after that person has ceased to be a member of the City Council. 2.50.030 Compensation.
The City Manager shall receive such salary and other compensation as established by contract or as the City Council may determine and establish by resolution. (Ord. CCO-02-03, 2002; Ord. CCO-97-03, 1997)
2.50.040 Hours.
The City Manager shall devote full time and energy to the performance of the Manager’s duties to the City. The City Manager shall not accept other employment without first receiving the approval of the City Council. (Ord. CCO-02-03, 2002; Ord. CCO-97-03, 1997)
2.50.050 Bond.
The City Manager shall furnish a corporate surety bond in such amount as the Council may from time to time require, the form of such bond and insurer to be approved by the City Council. The bond shall be conditioned upon the faithful performance of the City Manager’s duties. The premium for such bond shall be paid by the City. (Ord. CCO-02-03, 2002; Ord. CCO-97-03, 1997)
2.50.060 Duties.
The City Manager shall be the administrative head of the City government under the direction and control of the City Council and shall be responsible to the City Council for the efficient administration of all City affairs under the City Manager’s control. It shall be the City Manager’s duty:
(A) To oversee the enforcement of all laws and ordinances;
(B) To employ discipline and remove all department heads and all subordinate officers and employees of the City; provided, however, that nothing in this section is intended to apply to the City Attorney, City Clerk or City Treasurer;
(C) To transfer employees from one department to another;
(D) To consolidate or combine positions, offices or departments as may be appropriate;
(E) To exercise supervision and control over all departments of City government and all appointed officers and employees, except as provided in this section;
(F) To attend meetings of the City Council and committees of the City Council and the community where appropriate, and to act as Clerk when attending closed sessions of the City Council and to keep accurate and confidential records of closed sessions;
(G) To advise and report to the City Council on the financial conditions and needs of the City;
(H) To prepare the annual budget for submission to the City Council;
(I) To prepare and maintain a City salary plan;
(J) To exercise general supervision over public buildings and other public property under the control of the City Council;
(K) To conduct investigations into the affairs of the City and departments thereof and any complaints against the City’s officers, operations or employees and to report the results thereof to the City Council;
(L) To coordinate public relations and promotional efforts of City government;
(M) To purchase all supplies for all of the departments and divisions thereof;
(N) To perform such other duties and exercise such other powers as may be delegated to the City Manager by the City Council;
(O) To appoint a City Manager Pro Tempore to serve in the absence of the City Manager; and
(P) To prepare the meeting agenda in consultation with the Mayor and City Council. (Ord. CCO-02-03, 2002; Ord. CCO-97-03, 1997)
2.50.070 Administrative control.
Except for the purposes of exercising the right of inquiry, the City Council and its members shall deal with the City administrative service and its employees solely through the City Manager. Neither the City Council nor any members of the City Council shall give orders or directions to any subordinates of the City Manager. Any subordinate of the City Manager receiving directions or orders from a City Council member shall report that event to the City Manager. The City Manager shall report to the City Council any incidents of orders or directions being given to subordinates by members of the City Council. (Ord. CCO-02-03, 2002; Ord. CCO-97-03, 1997)
2.50.080 Powers and duties – Generally.
The City Manager shall be the administrative head of the government of the City under the direction and control of the City Council except as otherwise provided by ordinance. He or she shall be responsible for the efficient administration of all the affairs of the City which are under his or her control. The City Council may at its discretion, by resolution, grant or delegate additional powers, or, except for such powers as are specified in this chapter, reduce the powers, of the City Manager. Should the City Manager be unable to fulfill his or her duties, and be unable to appoint a City Manager Pro Tempore to act in his or her stead, Council will appoint a City Manager Pro Tempore to temporarily assume the duties of the absent City Manager. 2.50.090 Reservation of authority.
The City Council retains the sole authority and power as the policy-making and legislative body of the City. Nothing herein is intended to delegate such authority to the City Manager. The duties, powers and authority of the City Manager are expressly confined to the administrative service of the City. (Ord. CCO-02-03, 2002; Ord. CCO-97-03, 1997)
