3.28.010 City funds.

All monies of the City shall be deposited into the various funds as may be established by the City Council or the Finance Officer. (Ord. CCO-96-07 § 29, 1996; Ord. 89 § 19, 1930)

3.28.020 Transfer of funds.

The City Council may, by order, transfer sums from one fund to the other, as in their judgment may best serve the public interest; provided, that the bond redemption and interest fund must remain intact. (Ord. 89 § 20, 1930)

3.28.030 Warrants – Account of each fund – Report.

No warrants shall be drawn upon either fund, nor shall the same be paid by the Treasurer, unless in pursuance of an appropriation by the City Council, previously duly made, to pay for services, labor, material, improvements or other obligations, first properly and legally authorized or incurred, and the Treasurer shall keep a separate account of each fund in a book of accounts and shall, on the second Friday of each month, report to the Council, in writing, the balance remaining in his hands to the credit of each of the funds. 3.28.040 Duty of City Council.

It shall be the duty of the City Council to order, or otherwise to specify, what expenses shall be chargeable against each fund, and to further regulate the making, filing, auditing, allowance and payment of demands against the City treasury and the various funds. (Ord. 89 § 22, 1930)

3.28.050 Form of claims.

Claims submitted to the City for payment shall be adequately itemized and detailed so as to reveal such information as may be deemed necessary by the City Manager or his/her nominee, and generally, the following: name of claimant, date of submission, description of services rendered or goods furnished, and date that services or goods were provided. Tort claims shall conform to the requirements of law as they may exist at the time of submission. (Ord. CCO-96-06, 1996; Ord. 89 § 23, 1930)

3.28.060 Filing, approval, rejection, and denial of claims.

Claims shall be filed with the City Clerk, and may thereupon be accepted and paid in full, approved in part only and partial payment offered in full satisfaction thereof, denied in their entirety, or rejected because of noncompliance with applicable laws or this code. Claims which are rejected because of noncompliance with requirements as to form or contents may be refiled if otherwise permitted under law. Partially approved claims which are not accepted by the claimant may be reconsidered by the Council without the necessity of refiling. (Ord. CCO-96-06, 1996; Ord. 89 § 24, 1930)

3.28.070 Administrative approval or rejection of claims.

All claims shall be promptly submitted by the City Clerk to the City Council for action, except as provided herein.

(A) The City Manager may withhold any tort claim and allow the same to be deemed denied by operation of law upon the expiration of the time allowed by statute, in lieu of submitting the same to the City Council for action, if he/she determines that it would be in the best interests of the City to do so.

(B) The City Clerk may reject any claim if the form of the same is not in compliance with applicable statutes or this code.

(C) The City Manager or Finance Officer may approve any nontort claim, and direct issuance of a warrant therefor without the necessity of Council approval if the Council has previously approved a budgetary appropriation for same, but if no such appropriation has been approved, the warrant must be approved by the Council before payment.

(D) The City Manager or Finance Officer, in consultation with the other, and with the written approval of the City Attorney, may approve any tort claim without Council approval if the same does not exceed $2,500. No claim for a single incident may be segregated into parts so as to not exceed this limitation.

(E) Claims responded to under the authority of subsections (A) through (D) of this section shall be reported to the City Council. (Ord. CCO-96-06, 1996; Ord. 89 § 25, 1930)

3.28.080 Certification of claims by officer.

All claims created by the order or direction of any officer of this City must be certified by such officer as having been ordered by him before the same is acted on by the City Council. (Ord. 89 § 26, 1930)
