12.16.010 Barriers and lanterns required.
Any person by whose act or at whose instance, either as principal, agent or employee, and whether in the making of improvements, erection of buildings or otherwise, any part or portion of any street, alley, lane, court, place or sidewalk has been made dangerous shall maintain a good and substantial barrier and keep one or more lighted lanterns from sunset to sunrise on or around such dangerous place during the existence of such danger. 12.16.020 Permit required – Bond.
No person shall be permitted to dig or maintain trenches, holes, sewers, drains or excavations in the streets, alleys or thoroughfares of the City, or change or alter grades, slopes or existing conditions, without previous authority and permission first had and obtained from the City Council upon petition therefor setting forth in detail the reasons, object and purpose for which such permission is sought, and in granting such permit such restrictions and conditions shall be imposed as will safeguard the public health, safety and convenience, and proper and adequate security shall be exacted to the end that such street, place or alley shall again be put into safe and proper condition; provided, however, that plumbers and persons whose business it is to lay water or sewer pipes or make sewer connections or connect houses with the public water service may give bond to the City in the sum of $250.00, with good and sufficient sureties, conditioned upon due compliance with the terms of this section, and upon giving and filing with the Clerk of the City the bond, the latter first having been approved by the City Council, in writing, and the City Attorney having endorsed the statement that such bond is in legal form, such person furnishing bond as aforesaid shall be exempt from obtaining the permit herein provided for during the period of one year. For any breach of the conditions of such bond either the City or any persons whose interests have been detrimentally affected may bring suit to recover the penalty of such bond in a court having jurisdiction.
