11.12.010 Designation of Protected Swimming Areas.
The areas of the City of Newport Beach in or along Newport Harbor and in or along the Pacific Ocean hereinafter described shall be “protected swimming areas.” (Ord. 1090 (part), 1964: 1949 Code § 10700)
11.12.020 Swimming Area No. 1.
Beginning at the point of intersection of the southerly prolongation of the easterly line of Marine Avenue, as Marine Avenue is shown on a map of Section 4, Balboa Island, recorded in Miscellaneous Maps, Book 7, Page 37, Records of Orange County, with the U.S. bulkhead line between U.S. Stations 255 and 256; thence southerly along the southerly prolongation of the easterly line of Marine Avenue, a distance of ninety-six (96) feet, to the U.S. pierhead line; thence westerly along the U.S. pierhead line to an intersection with the southerly prolongation of the westerly line of Lot 4, Block 1, of Section 4 of Balboa Island; thence northerly along the southerly prolongation ninety-six (96) feet to an intersection with the U.S. bulkhead line; thence easterly along the bulkhead line to the point of beginning. 11.12.030 Swimming Area No. 2.
Beginning at the point of intersection of the northerly prolongation of the easterly line of Lot 15, Block 13, Section 3, Balboa Island, as said tract is shown upon a map recorded in Miscellaneous Maps, Book 7, Page 15, with the northerly line of Lot “B” of Section 3, Balboa Island; thence northerly along the northerly prolongation of the easterly line of Lot 15, to an intersection with the U.S. bulkhead line between U.S. Stations 151 and 152; thence westerly along the U.S. bulkhead line to an intersection with the northerly prolongation of the westerly line of Lot 15, Block 12, of Section 3, Balboa Island; thence southerly along the northerly prolongation, to an intersection with the northerly line of Lot “B”; thence easterly along the northerly line of Lot “B”, to the point of beginning. 11.12.040 Swimming Area No. 3.
Beginning at the most northerly corner of Lot 40, Tract 756, as shown upon a map, recorded in Miscellaneous Maps, Book 23, Pages 7 and 8, Records of Orange County, California; thence northeasterly along the northeasterly prolongation of the northwesterly line of Lot 40, to an intersection with the U.S. pierhead line; thence southeasterly along the U.S. pierhead line to an intersection with the northeasterly prolongation of the southeasterly line of “N” Street, as shown on Tract No. 756; thence southwesterly along the northeasterly prolongation to the northeasterly line of Tract No. 756; thence northwesterly along the northeasterly line of Tract No. 756 to the point of beginning. 11.12.050 Swimming Area No. 4.
Beginning at the point of intersection of the northeasterly line of Shell Street and southeasterly line of Fernleaf Avenue, as said streets are shown upon a map of Corona del Mar, recorded in Miscellaneous Maps, Book 3, Pages 41 and 42, Records of Orange County, California; thence southwesterly along said southeasterly line of Fernleaf Avenue and the southwesterly prolongation thereof, to an intersection with the line of mean high tide, as described in Superior Court Case No. 23688, in and for the Superior Court of Orange County, California; thence northerly along the Mean High Tide Line to an intersection with the northwesterly line of Dahlia Avenue, as shown upon the Map of Corona del Mar; thence northeasterly along the northwesterly line of Dahlia Avenue, to an intersection with the northwesterly prolongation of the northeasterly line of Shell Street; thence southeasterly along the northwesterly prolongation and the northeasterly line of the southeasterly prolongation of the northeasterly line of Shell Street, to the point of beginning. 11.12.060 Swimming Area No. 5.
Beginning at a point in the U.S. Bulkhead line between U.S. Station 116 and U.S. Station 117, said point of beginning being fifty (50) feet southeasterly of the southeasterly Line of 10th Street; thence southeasterly along the U.S. bulkhead line a distance of two hundred (200) feet; thence northeasterly parallel to 10th Street to an intersection with the U.S. pierhead line; thence northwesterly along the U.S. pierhead line a distance of two hundred (200) feet; thence southwesterly to the point of beginning. 11.12.070 Swimming Area No. 6.
Beginning at a point in the east jetty of Newport Harbor four hundred fifty (450) feet southerly of the mean high tide line of the Pacific Ocean; thence easterly parallel to and four hundred fifty (450) feet southerly of the mean high tide line, a distance of one thousand four hundred fifty (1,450) feet; thence due north to an intersection with the mean high tide line; thence westerly along the mean high tide line to the east jetty; thence southerly along the east jetty to the point of beginning. 11.12.080 Swimming Area No. 7.
Beginning at the most northerly corner of Lot 4, Block 218, as shown upon a map of Section “B,” Newport Beach, recorded in Miscellaneous Maps, Book 4, Page 27, records of Orange County, California; thence southeasterly along the northeasterly line of Lot 4 a distance of sixty-five (65) feet; thence northeasterly at right angles to the northeasterly line to a point in a line lying northeasterly of, parallel to, and distant fifty (50) feet from the northeasterly line of Lot 4, said point being the true point of beginning; thence continuing northeasterly at right angles to the northeasterly line to an intersection with the U.S. pierhead line; thence southeasterly along the pierhead line to an intersection with the northeasterly prolongation of the northwesterly line of Lot 17, of Block 218; thence southwesterly along the northeasterly prolongation to an intersection with the aforementioned parallel line; thence northwesterly along said parallel line to the true point of beginning. 11.12.090 Swimming Area No. 8.
Beginning at the point of intersection of the northeasterly prolongation of the northwesterly line of Lot 17, Block 218, as shown upon map of Section “B” Newport Beach, recorded in Miscellaneous Maps, Book 4, Page 27, records of Orange County, California, and the U.S. pierhead line; thence southeasterly along the U.S. pierhead line to an intersection with the northeasterly prolongation of the northwesterly line of 17th Street as shown upon a map of Section “B”; thence southwesterly along the northeasterly prolongation of 17th Street to an intersection with a line lying parallel to and distant three hundred ten (310) feet from and northeasterly of the northerly line of Balboa Boulevard; thence northwesterly along said parallel line to an intersection with the aforesaid northeasterly prolongation of the northwesterly line of Lot 17, Block 218; thence northeasterly along the northeasterly prolongation of the northwesterly line of Lot 17 to the point of beginning. 11.12.100 Swimming Area No. 9.
Beginning at the point of intersection of the southeasterly line of Goldenrod Avenue as shown upon a map of Corona del Mar, recorded in Miscellaneous Maps, Book 3, Pages 41 and 42, records of Orange County, California, and the mean high tide line of the Pacific Ocean; thence easterly and southerly along the high tide line to an intersection with the southwesterly line of Shore Avenue as shown upon the Map of Corona del Mar; thence northwesterly along the southwesterly line of Shore Avenue to an intersection with the southwesterly prolongation of the northwesterly line of Goldenrod Avenue as shown upon the map of Corona del Mar; thence northeasterly along the southwesterly prolongation and along the northeasterly line of Goldenrod Avenue to an intersection with the high tide line of the Pacific Ocean; thence easterly along the high tide line to the point of beginning. 11.12.110 Swimming Area No. 10.
Beginning at a point of intersection of the mean high tide line of the Pacific Ocean and the southwesterly prolongation of the northeasterly line of Poppy Avenue, as shown upon a map of Tract No. 673, recorded in Miscellaneous Maps, Book 20, Pages 17 and 18, records of Orange County, California; thence southwesterly along the southwesterly prolongation of the northeasterly line of Poppy Avenue a distance of two hundred (200) feet; thence easterly along a line lying parallel to and distant two hundred (200) feet southerly of the mean high tide line to an intersection with the southwesterly prolongation of the northeasterly line of Beach Drive as shown upon a map of Tract No. 673; thence northeasterly along the southwesterly prolongation of the northwesterly line of Beach Drive to an intersection with the mean high tide line; thence westerly along the mean high tide line to the point of beginning. 11.12.120 Activities Restricted in Swimming Areas.
When lines and floats or buoys are in place outlining protected swimming areas, whether designated by the City or the County, no person shall operate, drive, navigate, use or possess within, or take, drive, propel or permit to drift into a protected swimming area any boat, vessel, surfboard, skid board, skimmer board, ski, paddleboard, canoe or similar object made entirely or partially of wood, metal, glass, hard plastic or any other hard substance.
There is excepted from the provisions of this section the use of a surfboard, paddleboard, or similar device, in that portion of any protected swimming area which is designated a surfing area during the hours surfing is permitted therein. (1949 Code § 10720 as amended by Ord. 1090; August 24, 1964)
11.12.130 Prohibited Swimming Areas.
It shall be unlawful for any person in the act of swimming to be in any portion of the main channel or entrance channel of Newport Harbor from the harbor entrance to the turning basin, as the same are shown on the U.S. Harbor Line Map File No. 958, Los Angeles District U.S. Army Engineers and as shown on U.S. Coast & Geodetic Survey Chart No. 5108 on file in the district office. 11.12.150 Diving or Jumping from Public Property.
It is hereby declared unlawful for any person or persons to dive, jump or enter into the water from any public bridge, public pier, public wharf, public float immediately in front of any such pier or wharf, public bulkheads, seawalls, groins, or jetties or natural rock formation on City property within the City of Newport Beach. This section shall not prohibit an employee of the City from entering into the water when necessary in the course of employment. Any person violating the provisions of this section shall be deemed guilty of a misdemeanor. 11.12.160 Swimming and Diving Prohibited in Harbor Entrance.
No person shall wade, bathe, skin dive, or swim in the following described area at the entrance to Newport Harbor:
Beginning at a point of intersection of the southerly line of Shore Avenue as shown upon a map of Corona del Mar, recorded in Miscellaneous Maps, Book 3, Pages 41 and 42, records of Orange County, California, and the centerline of the east jetty, thence southerly along the centerline of the east jetty to the end of the jetty, thence southerly along a line parallel to the southerly prolongation of the centerline of the west jetty to a point five hundred (500) yards beyond the end of the east jetty, thence westerly along a line perpendicular to the centerline of the west jetty to an intersection with the prolongation of the centerline of the west jetty, thence northerly along the centerline of the west jetty and its prolongation to the southerly line of Lot 1, Block P, of Tract 518, recorded in Miscellaneous Maps, Book 17, Pages 33 and 34, records of Orange County, California, thence easterly across the channel to the point of beginning. 11.12.170 Crafts Prohibited in Harbor Entrance.
It shall be unlawful for any person to operate any paddleboard, kayak, pedalo, life raft or similar type of craft used for the transportation of persons in any portion of the main channel or entrance channel of Newport Harbor as defined in Section 11.12.160.
