1.04.010 Title.

This code shall be known as the Pacific Grove Municipal Code. [Ord. 210 N.S. § 1-101, 1952].

1.04.020 Contents of code.

This code consists of those regulatory, administrative and other ordinances of the city appropriate for systematic codification. [Ord. 210 N.S. § 1-102, 1952].

1.04.030 Divisions of code.

This code shall be divided into titles. Each title is divided into chapters which are composed of sections. Each section number consists of three component parts separated by decimals: the first figure refers to the title, the middle figure to the chapter, and the third figure refers to the position of the section within the chapter. 1.04.040 Date code takes effect.

This code takes effect at 12:00 noon of the day following its adoption. [Ord. 210 N.S. § 1-104, 1952].

1.04.050 Adoption of code.

This council hereby accepts and adopts the “Municipal Code of the City of Pacific Grove, 1995 Edition,” on file in the office of the city clerk, which includes all codified ordinances through Ordinance No. 1994 N.S., to fully and completely replace the printed version of this code duly adopted and compiled through said Ordinance No. 1994 N.S. All subsequent revisions, i.e., all revisions contained in ordinances enacted after Ordinance No. 1994 N.S., to this code shall be to, and shall follow the format and style of, said 1995 Edition. 1.04.060 Effect of adoption.

The adoption of this code and the repeal of ordinances by this code shall not affect the following matters:

(a) Ordinances adopted subsequent to October 1, 1963, and purporting to be provisions of the preexisting municipal codes of this city and prior to the effective date of this code;

(b) Actions and proceedings which began before the effective date of this code;

(c) Prosecution for ordinance violations committed before the effective date of this code;

(d) Licenses and penalties due and unpaid at the effective date of this code, and the collection of these licenses and penalties;

(e) Bonds and cash deposits required to be posted, filed or deposited pursuant to any ordinance;

(f) Matters of record which refer to or are connected with ordinances the substances of which are included in this code; these references shall be construed to apply to the corresponding provisions of the code. [Ord. 444 N.S. § 2, 1963].

1.04.070 Continuation of existing law.

Where they are substantially the same as existing law, the provisions of this code shall be considered continuations of existing law and shall not be considered new enactments. [Ord. 444 N.S. § 3, 1963].

1.04.080 Repeal of inconsistent prior enactments.

All provisions of ordinances which are in conflict with the provisions of this code are hereby repealed. This section shall not be construed to revive any ordinance which was repealed before the adoption of this code. [Ord. 444 N.S. § 4, 1963].

1.04.090 Catchlines of sections.

The catchlines of the several sections of this code printed in bold face type are intended as mere catchwords to indicate the contents of the sections and shall not be deemed or taken to be titles of such sections, nor as any part of the section, nor, unless expressly so provided, shall they be so deemed when any of such sections, including the catchlines, are amended or reenacted. 1.04.100 Severability of provisions.

If any article, chapter, section, subsection, paragraph, sentence, clause or phrase of this code is held invalid or unconstitutional for any reason by a court of competent jurisdiction, that holding shall not affect the validity or constitutionality of the remainder of this code. The city council hereby declares that it would have adopted each part of this code irrespective of the validity of any other part. [Ord. 444 N.S. § 6, 1963].
