10.04.010 Definitions generally.
Whenever in Ordinance 116, codified in this chapter and throughout Chapters 10.08 through 10.20, the following terms are used, they shall have the meaning respectively ascribed to them in this section:
A. “Alley” is any highway having a roadway not exceeding twenty-five feet in width which is primarily used for access to the rear or side entrances of abutting property.
B. “Park or parking” means the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
C. “Vehicle” is a device by which any person or property may be propelled, moved or drawn upon a highway, excepting a device moved by human power or used exclusively upon stationary rails or tracks. (Ord. 244 § 1, 1974: Ord. 116 § 2(a), 1952).
10.04.020 Business district boundaries designated.
“Business district” for the purpose of Ordinance 116, codified in this chapter and throughout Chapters 10.08 through 10.20, includes not only those portions of highways and the property contiguous thereto, having the percentage of buildings fronting on such highways required by Section 89 of the Vehicle Code of the state but also all other streets and highways located within the territory bounded by El Circulo Avenue and Second Street, although the buildings in use for business fronting thereon may amount to less than the percentage mentioned in Section 89. 10.04.030 Applicability to bicycles and animals.
Every person riding a bicycle or riding or driving an animal upon a highway has all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by Ordinance 116, codified in this chapter and throughout Chapters 10.08 through 10.20, except those provisions which by their very nature can have no application. 10.04.040 Driver’s duty to turn right in Plaza area.
It shall be the duty of any person driving or propelling any automobile, motorcycle or other vehicle or causing same to be propelled from any street in the city into the Plaza, to turn said vehicle to the right and continue in said direction until the street into which said person desires to turn is reached. All left turns and U-turns in the Plaza or at the intersection of any streets with the Plaza are prohibited. (Ord. 116 § 3, 1952).
10.04.050 Authority to regulate traffic.
The city council is authorized to determine and establish by resolution additional streets and locations in the city where stopping of vehicles shall be unlawful or shall be permitted only for a limited time, or within limited hours, or shall be subject to such other regulations and restrictions as to the city council shall appear reasonable. The restrictions and regulations imposed by Ordinance 116, codified in this chapter and throughout Chapters 10.08 through 10.20 as to stopping of vehicles may be changed or rescinded by resolution of the city council. Streets or alleys may be declared to be one-way streets or alleys, by resolution of the city council, and the city council is in general authorized to make, establish or change by resolution all or any regulations and rules regarding the use of or traffic upon the streets, alleys and roadways of the city, unless same are specifically required by laws of the state to be done by ordinance. 10.04.060 Penalty for violations.
A. Any person violating any provision of Ordinance 116, codified in this chapter and throughout Chapters 10.08 through 10.20 is guilty of a misdemeanor, and upon conviction thereof, shall be punishable by a fine not exceeding five hundred dollars, or by imprisonment in the county jail for a period not exceeding six months or by both such fine and imprisonment.
B. Violation of the terms and provisions of the resolution set out in Chapter 10.12, adopted pursuant to Ordinance 116, codified in this chapter and throughout Chapters 10.08 through 10.20 is a violation of Ordinance 116, codified in this chapter and throughout Chapters 10.08 through 10.20.
