VOLUNTARY MERGERS

16.26.010 Purpose.
The purpose of this chapter is to provide for the owner-initiated merger of contiguous parcels under common ownership without reversion to acreage, pursuant to Section 66499.20 3/4 of the Government Code. For purposes of this chapter, “contiguous” means sharing a common boundary. (Ord. 05-002 § 1 (part), 2005)
16.26.020 Initiation by property owner.
Proceedings to merge contiguous parcels may be initiated by petition of the owner of record of the parcels. The petition shall be in a form and contain the information prescribed by the planning division. (Ord. 05-002 § 1 (part), 2005)
16.26.030 Review procedure.
The planning manager has the authority to approve a voluntary merger. A voluntary merger may be approved if it is found that all of the properties involved in the merger are in common ownership. The owner of the property may appeal the planning manager’s decision to the planning commission within ten days after notice of the decision is sent to the owner. (Ord. 05-002 § 1 (part), 2005)
16.26.040 Development requirements.
Mergers approved under the provisions of this chapter shall be subject only to those conditions that ensure that the proposed parcel meets the minimum area and width requirements of the zoning district in which it is located. All mergers shall be recorded with a notice of merger, pursuant to Government Code Section 66451.12. (Ord. 05-002 § 1 (part), 2005)
