16.30.010 Purpose.
The purpose of this chapter is to provide for a method of reviewing applications for lot line adjustments. (Ord. 05-002 § 1 (part), 2005)
16.30.020 Requirements for application.
An application for a lot line adjustment shall include a site plan and may be accepted only if the following apply:
A. Number of Existing Parcels. The number of currently existing parcels does not exceed four;
B. Number of Resulting Parcels. The application approval will not result in more parcels than currently exist;
C. Common Boundary. The currently existing parcels share a common boundary; and
D. Agreement. The application includes written agreement of all owners of parcels whose size or configurations will be affected by the proposed lot line adjustment. (Ord. 05-002 § 1 (part), 2005)
16.30.030 Review procedures.
The planning manager has the authority to approve a lot line adjustment; provided, however, he or she may refer an application to the planning commission for action. The owner of the property may appeal the planning manager’s decision to the planning commission within ten days after notice of the decision is sent to the owner. (Ord. 05-002 § 1 (part), 2005)
16.30.040 Approval requirements.
A. Approval of Application. The application shall be approved if the following provisions exist:
1. The application requirements in Section 16.30.020 are met; and
2. The lot line adjustment will conform to the general plan, any applicable specific plans, and zoning and building ordinances of the city or will not increase the nonconformance if such already exists.
B. Conditions of Approval. Conditions of approval shall be limited to the following:
1. Conditions necessary to ensure the lot line adjustment conforms to the general plan, any applicable specific plans, and zoning and building ordinances;
2. Conditions to require the prepayment of real property taxes; and
3. Conditions to facilitate the relocation of existing utilities, infrastructure or easements. (Ord. 05-002 § 1 (part), 2005)
16.30.050 Approval documentation.
Approved lot line adjustments shall be reflected in a deed that is filed with the county recorder. A record of survey is required only if required by Section 8762 of the Business and Professions Code. (Ord. 05-002 § 1 (part), 2005)
