2.10.010 Membership – Terms of office and election.

The City Council is the governing body of the City, whose members shall be elected from the City at large for a term of four years, at the times and in the manner as provided in Section 700 of the Charter. (Ord. 947. Formerly § 2-10).

2.10.020 Powers and duties – Generally –Mayor to serve as chairman – Conduct of meetings.

All powers of the City shall be vested in the City Council subject to the provisions of the Charter and to the laws and Constitution of the State. The Mayor shall be titular head of the governing body and shall serve as chairman of its meetings, which shall be conducted under Roberts' Rules of Order, except that the votes of Councilmen who are present but do not vote (abstain) may not be counted as an affirmative or negative vote. 2.10.030 Appointment of City officers, etc.

The duties of the City Council shall be to appoint the City Manager, City Attorney, City Auditor or Controller and the members of the various boards and commissions, for terms of office prescribed by the Charter. (Ord. 947. Formerly § 2-12).

2.10.040 Policies – Rules and regulations.

The City Council shall formulate policy and establish rules and regulations for the governing of the City through the legal use of ordinances, resolutions and oral motions or orders duly passed and entered in the official minutes of its meetings. (Ord. 947. Formerly § 2-13).

2.10.050 Publishing of legal notices.

(a) The City Council shall by resolution designate one or more newspapers of general circulation in the city as official newspaper for the publication of any legal notice or other matter required to be published in a newspaper of general circulation in said city. If it appears to the City Council that the rates are unfair, it need not designate an official newspaper. Upon making a finding to such effect, or if publication of newspapers which have been so designated are suspended, then legal notices, ordinances, or other matter required to be published in an official newspaper may be published by posting copies thereof in at least three public places in the city.

(b) The places for posting of legal notices, ordinances or other matter required to be posted shall be, and hereby are, fixed by this ordinance of the City Council to be any of the following:

(1) Outside the entrance to the City Hall Council Chambers.

(2) City’s Central Park Library.

(3) City’s Mission Branch Library.

(4) City’s Northside Branch Library.

(c) No defect or irregularity in proceedings taken under this section or Section 815 of the City's Charter, or failure to designate an official newspaper, shall invalidate any publication. (Ord. 1298 § 1, 10-15-74; Ord. 1976 ยง 1, 2-6-18. Formerly § 2-13.1).

2.10.060 Fiscal program – Taxes, public works contracts, budget, etc.

The fiscal program of the City shall be established by the Council in the manner set forth in the Charter and shall include the levying of taxes, the awarding of public works contracts, the adoption of a budget, the approval of demands against the City and the engagement of an independent auditor.
