KEEPING OF POULTRY, FOWL AND OTHER DOMESTIC ANIMALS

6.08.010 Permit – Required for the keeping of certain animals.

It is unlawful for any person, firm or corporation to keep, harbor, or maintain any poultry, chickens, turkeys, ducks, geese, rabbits, hares, cows, goats, sheep or other domesticated animals except cats and dogs, or to cause, permit or allow the same to be kept or maintained, in any premises within the City without first having obtained a permit therefor from the Health Officer of the City. 6.08.020 Permit – Application requirements.

Any person desiring or intending to keep, harbor or maintain any of such fowl, poultry or domesticated animals shall make written application to the Health Officer of the City for a permit therefor.

Such application shall contain the name and residence of the applicant, the owner, tenant and person in possession of the premises where the same are to be kept, the number of such fowl or animals desired to be kept and whether permanently or temporarily, together with a statement of the kind, nature and location of the sheds, coops, pens or other housing facilities for such fowl, poultry or animals. 6.08.030 Permit – Inspection of premises by Health Officer.

Within five days after the receipt of an application the City Health Officer shall make an examination of the premises and shall ascertain therefrom and from the statement of the applicant the sanitary conditions of the premises, the way the same are to be kept and whether the same will with reasonable probability result in unsanitary conditions or be injurious to the health and welfare of the occupants of the premises or occupants of premises adjacent thereto or situated so close thereto as to be injuriously affected in matters of health and sanitation by the keeping of the fowl, poultry or animals. 6.08.040 Permit – Issuance.

If it appears to the City Health Officer that the fowl, poultry or animals may be kept without injury to the health and sanitation of the occupants and person residing adjacent to the premises, then the City Health Officer shall issue a permit therefor. [Ord. 385 § 3, 1946.]

6.08.050 Inspection of premises.

All places and premises where any of the fowl, poultry or animals are kept shall be open at all reasonable times to the inspection of the City Health Officer. [Ord. 385 § 4, 1946.]

6.08.060 Power of Health Officer to make regulations and revoke permits.

The City Health Officer shall make all reasonable and lawful sanitary regulations for the keeping of poultry, fowl or other animals and all permits issued by him shall be revocable by the City Health Officer whenever in his opinion public health, sanitation, safety and welfare shall require. 6.08.070 Penalty for violation.

Any person, firm or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not exceeding $50.00 or by imprisonment in the County Jail for a term not exceeding 10 days or by both such fine and imprisonment.
