PAY PARKING FACILITIES

4.30.010 Permit required.
Without having first obtained a permit from the city council, no person shall use or authorize the use of any off-street parking lot or facility, or portion thereof, for the parking of vehicles for a fee or other consideration when the parking does not primarily serve uses or businesses located on the same property, or on immediately adjoining property, owned or leased by the operator of the parking lot or facility. (Ord. 38 § 1(A), 1987)
4.30.020 Application and fee.
An application for a permit shall be filed with the city manager along with an application processing fee in an amount established by city council resolution. (Ord. 38 § 1(B), 1987)
4.30.030 Required determinations.
Before issuing a permit under SBMC 4.30.010, the city council shall determine:
A. That the applicant has complied with the environmental review requirements of city Ordinance No. 20;
B. That the proposed use of the off-street parking facility will not:
1. Adversely affect public health, safety or welfare,
2. Create adverse noise or circulation impacts in the vicinity of the lot or facility, or
3. Eliminate required off-street parking for any permitted use primarily served by the parking lot or facility. (Ord. 38 § 1(C), 1987)
4.30.040 Approval or denial of permit.
The city council may approve, conditionally approve, or deny the application for the permit in its sole discretion. The city council may condition a permit upon such conditions which the city council deems reasonably necessary to mitigate any burdens or impacts, created by or contributed to, by the proposed use of the parking lot or facility. 4.30.050 Shuttle bus service – Evaluation of impacts.
If the applicant for the permit, or any other person, proposes to provide a shuttle bus or similar service between the facility and any other location, the application shall include the proposed route, schedule of service and any other information deemed necessary by the city manager in order to properly evaluate the impacts resulting from provision of the shuttle bus or similar service.
