§6100 OPERATION OF DEVICE INTERFERING WITH RADIO SIGNALS UNLAWFUL
It shall be unlawful for any person to operate, or to cause or permit to be operated, in the City, any electrical device, appliance, equipment or apparatus which causes, generates or produces high frequency oscillations or other electrical disturbances which interfere with the reception of radio signals, and the operation of any such electrical device, appliance, equipment or apparatus is hereby declared to constitute a public nuisance. §6101 ELECTRIC DEPARTMENT PERSONNEL TO ENFORCE RIGHT TO INSPECT
It shall be the duty of the Department of Electricity of the City, hereinafter referred to as the "Department" to enforce the provisions of this Article and the City Electrician of the City is hereby authorized to appoint such special assistants and/or deputies as may be necessary to carry out the provisions hereof. All such assistants and/or deputies shall serve without pay. The City Electrician, or his duly authorized assistants or deputies, shall have the right to enter upon any premises at all reasonable hours for the purpose of inspecting the installation, working or operation of all devices, appliances, equipment or apparatus, coming within the terms hereof, and it shall be unlawful for any person to interfere with the City Electrician or his assistants or deputies in making such inspection, or to refuse to permit such inspection to be made. §6102 PENALTY FOR FAILURE TO ABATE NUISANCE AFTER NOTICE
Every person maintaining, owning or operating a public nuisance as herein defined who shall fail to abate the same within five (5) days after the mailing of written notice by said Department of the existence of such nuisance, shall be guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not to exceed one hundred dollars ($100.00), or by imprisonment of not to exceed thirty (30) days, or both such fine and imprisonment. Each day that such nuisance is maintained after such five (5) day period shall constitute a separate offense. (Ord. 328, §3, adopted 1937)
§6103 AUTHORITY TO DISCONTINUE ELECTRIC SERVICE AFTER NOTICE
The Department shall have power and authority to discontinue electrical power and/or lighting service to any premises upon which there is being maintained, or operated, any electrical device, equipment, appliance or apparatus which causes, generates, or produces high frequency oscillation or other electrical disturbances, which interfere with the reception of radio signals when the person owning, operating, or maintaining the same, willfully or deliberately fails or refuses to make proper or necessary changes, repairs, or additions to eliminate such interference for a period of five (5) days after the Department mails written notice that such interference exists. §6104 SALE OF INTERFERENCE PRODUCING DEVICE UNLAWFUL
The sale in the City of any electrical device, appliance, equipment or apparatus which causes, generates or produces high frequency oscillations or other electrical disturbances interfering with the reception of radio signals is hereby declared to be a misdemeanor. (Ord. 328, §5, adopted 1937)
§6105 PENALTY FOR VIOLATION
A violation of this Article is hereby declared to be a misdemeanor and is punishable by a fine of not to exceed one hundred dollars ($100.00), or by imprisonment in the City jail for not to exceed thirty (30) days or by both such fine and imprisonment. (Ord. 328, §6, adopted 1937)
§6106 LICENSED RADIO STATIONS AND X-RAY APPARATUS EXCEPTED
Nothing herein contained shall apply to radio transmitting stations licensed by the United States of America or to x-ray apparatus. (Ord. 328, §8, adopted 1937)
