§8010 DEFINITION OF TERMS

For the purposes of this chapter certain terms used in this chapter shall be defined as set forth in this article. (Ord. 533, §1.3, adopted 1958)

§8010.5 BUILDING SITE DEFINED

"Building site" means any area of a lot suitable for constructing a building or buildings. (Ord. 1081, §1, adopted 2006)

§8011 COUNCIL DEFINED

"Council" means the city council of the city of Ukiah. (Ord. 533, §1.31, adopted 1958)

§8012 CUL-DE-SAC DEFINED

"Cul-de-sac" means a minor street terminating in a turnaround. (Ord. 533, §1.38, adopted 1958)

§8013 ENGINEER DEFINED

"Engineer" means the city engineer of the city. (Ord. 533, §1.32, adopted 1958)

§8014 FRONT SETBACK LINE DEFINED

"Front setback line" means a line within a lot paralleling the street line between which lines the construction of buildings is prohibited. (Ord. 533, §1.43, adopted 1958)

§8015 HILLSIDE AREAS DEFINED

"Hillside areas" means land proposed to be subdivided which has an average difference in elevation of more than fifteen feet (15’) in a horizontal distance of one hundred feet (100’). (Ord. 533, §1.44, adopted 1958)

§8016 LOOP STREET DEFINED

"Loop street" means a minor street which forms a loop and returns to the same street from which it originated. A street forming a connection between two (2) streets is not a loop street. (Ord. 533, §1.39, adopted 1958)

§8016.5 MAJOR ACCESS ROADWAY DEFINED

"Major access roadway" means a right of way, easement, or other privately owned thoroughfare that affords the primary means of access between a dedicated street and two (2) or more lots with less public street frontage than required in the subdivision ordinance. (Ord. 1081, §1, adopted 2006)

§8017 MAJOR STREET DEFINED

"Major street" means a street carrying intercity through traffic or connecting several sections or neighborhoods within the city. (Ord. 533, §1.35, adopted 1958)

§8017.5 MINOR ACCESS ROADWAY DEFINED

"Minor access roadway" means a right of way, easement, or other privately owned thoroughfare that affords the primary means of access between a dedicated street and a single lot with less public street frontage than required in the subdivision ordinance. (Ord. 1081, §1, adopted 2006)

§8018 MINOR STREET DEFINED

"Minor street" means a street which serves only the abutting property. (Ord. 533, §1.37, adopted 1958)

§8019 PAVEMENT WIDTH DEFINED

"Pavement width" means the actual street pavement surface measured between the faces of the curbs. (Ord. 533, §1.42, adopted 1958)

§8020 "RESIDENTIAL USE" DEFINED

"Residential use" means any use of buildings or land for purpose of providing dwelling facilities separately or multiply, for human occupancy, whether on a temporary or permanent basis. (Ord. 561, §2, adopted 1964)

§8021 "RIGHT OF WAY" DEFINED

"Right of way" means the strip of land dedicated to, accepted and maintained by the City for street and utility purposes and on a portion of which a street is built. "Right-of-way" is abbreviated in this Chapter as "R.O.W.". (Ord. 533, §1.41, adopted 1958)

§8022 "SECONDARY STREET" DEFINED

"Secondary street" means a street which collects and carries traffic from minor streets to arterials or major streets, and also those streets which carry intercity traffic within a particular area of the City. (Ord. 533, §1.36, adopted 1958)

§8023 "STREET" DEFINED

"Street" means any public way not less than forty feet (40’) in width. (Ord. 533, §1.34, adopted 1958)

§8024 "STREET MAP" DEFINED

"Street map" means all official street maps now existing or which may be hereafter adopted or modified. (Ord. 533, §1.33, adopted 1958)

§8025 "SUBDIVIDER" DEFINED

Subdivider means a person, firm, corporation, partnership or association who proposes to divide, divides or causes to be divided real property into a subdivision for himself or for others. (Ord. 533, §1.45, adopted 1958; repealed by Ord. 682, §3, adopted 1976)

§8026 "SUBDIVISION" DEFINED

Subdivision means the division of any improved or unimproved land, shown on the latest equalized county assessment roll as a unit or as contiguous units for the purpose of sale, lease or financing, whether immediate or future. Property shall be considered as contiguous units even if it is separated by roads, streets, utility easement or railroad rights of way. Subdivision includes a condominium project, as defined in Section 1350 of the Civil Code or a community apartment project, as defined in Section 11004 of the Business and Professions Code. Any conveyance of land to a governmental agency, public entity or public utility shall not be considered a division of land for purposes of computing the number of parcels. Minor subdivision shall be as defined in §8300. (Ord. 682, §3, adopted 1976)
