2.60.010 By-district electoral system for six Councilmembers.

A. Pursuant to California Government Code Sections 34871(c) and 34886, commencing with the elections in November 2020, Councilmembers shall be elected by districts in six single-member districts.

B. Except as provided in subsection C of this section, the Councilmember elected to represent a district must live in that district and be a registered voter in that district, and any candidate for City Council must live in and be a registered voter in the district in which he or she seeks election at the time nomination papers are issued to the candidate, in accordance with applicable law.

C. A Councilmember in office at the time of the general municipal election in November 2020 and whose term continues beyond the general municipal election in November 2020 shall continue in office until the expiration of the full term to which he or she was elected or appointed and until his or her successor is qualified. If vacancies in Councilmember offices elected at-large occur before expiration of the full term thereof, such vacancies may be filled according to law on a by-district basis as provided in Section 2.60.030(D). The seat shall be filled by a person qualified to hold the office who lives in the specified district and consistent with the procedures set forth in Government Code Section 36512 et seq.

D. Upon expiration of the full term of each Councilmember elected at-large, that Councilmember’s successor shall be elected on a by-district basis in the districts established in Section 2.60.020 and as provided in Section 2.60.030. A vacancy in a Councilmember office elected by district shall be filled according to law by a person qualified to hold the office who lives in the district and consistent with the procedures set forth in Government Code Section 36512 et seq.

2.60.020 Districts.

A. Commencing with the November 2020 election, elections shall take place, and Councilmembers shall be elected, “by districts” as that term is defined in California Government Code Section 34871, meaning one member of the City Council shall be elected from each district, by the voters of that district alone.

B. The districts are as follows:

1. District 1. The region bounded and described as follows:

All of that portion of Solano County bounded and described as follows: 1. Beginning at the point of intersection of Stinson Ave and Deodara St, and proceeding northerly along Stinson Ave to the Vacaville city line, and proceeding easterly along the Vacaville city line to the Hartley/Vacaville census designated place/city line, and proceeding easterly along the Hartley/Vacaville census designated place/city line to the Vacaville city line, and proceeding southerly along the Vacaville city line to the Hartley/Vacaville census designated place/city line, and proceeding northerly along the Hartley/Vacaville census designated place/city line to the Vacaville city line, and proceeding southerly along the Vacaville city line to Walnut Rd, and proceeding westerly along Walnut Rd to Leisure Town Rd, and proceeding northerly along Leisure Town Rd to I-80, and proceeding westerly along I-80 to Putah South Cnl, and proceeding northerly along Putah South Cnl to E Monte Vista Ave, and proceeding westerly along E Monte Vista Ave to Browns Valley Pkwy, and proceeding northerly along Browns Valley Pkwy to Brown St, and proceeding southerly along Brown St to Markham Ave, and proceeding westerly along Markham Ave to Alpine St, and proceeding northerly along Alpine St to San Leon Dr, and proceeding westerly along San Leon Dr to Hilltop Ct, and proceeding southerly along Hilltop Ct to Markham Ave, and proceeding southerly along Markham Ave to property line, and proceeding westerly along property line to Bresee Ave, and proceeding southerly along Bresee Ave to Wesley Ave, and proceeding westerly along Wesley Ave to Vine St, and proceeding southerly along Vine St to E Monte Vista Ave, and proceeding westerly along E Monte Vista Ave to Dobbins St, and proceeding northerly along Dobbins St to E Deodara St, and proceeding westerly along E Deodara St to Deodara St, and proceeding westerly along Deodara St to the point of beginning. 2. 2. District 2. The region bounded and described as follows:

All of that portion of Solano County bounded and described as follows: 1. Beginning at the point of intersection of I-80 and unnamed Local road, and proceeding northerly along I-80 to Leisure Town Rd, and proceeding southerly along Leisure Town Rd to Walnut Rd, and proceeding easterly along Walnut Rd to the Vacaville city line, and proceeding southerly along the Vacaville city line to Fry Rd, and proceeding westerly along Fry Rd to Alamo Dr, and proceeding westerly along Alamo Dr to canal/aqueduct, and proceeding northerly along canal/aqueduct to Alamo Crk, and proceeding westerly along Alamo Crk to Nut Tree Rd, and proceeding northerly along Nut Tree Rd to unnamed Local road, and proceeding northerly along unnamed Local road to the point of beginning. 2. As well as beginning at the point of intersection of the Vacaville city line and the Elmira/Vacaville census designated place/city line, and proceeding northerly along the Vacaville city line to the Elmira/Vacaville census designated place/city line, and proceeding easterly along the Elmira/Vacaville census designated place/city line to the point of beginning.

3. District 3. The region bounded and described as follows:

All of that portion of Solano County bounded and described as follows: Beginning at the point of intersection of the Vacaville city line and nonvisible boundary, and proceeding northerly along the Vacaville city line to Stinson Ave, and proceeding southerly along Stinson Ave to Deodara St, and proceeding easterly along Deodara St to E Deodara St, and proceeding easterly along E Deodara St to Dobbins St, and proceeding southerly along Dobbins St to E Monte Vista Ave, and proceeding westerly along E Monte Vista Ave to West St, and proceeding southerly along West St to Merchant St, and proceeding northerly along Merchant St to Stevenson St, and proceeding easterly along Stevenson St to Boyd St, and proceeding southerly along Boyd St to McKnight Ln, and proceeding easterly along McKnight Ln to Davis St, and proceeding southerly along Davis St to unnamed Ramp, and proceeding southerly along unnamed Ramp to Davis St, and proceeding southerly along Davis St to Alamo Dr, and proceeding southerly along Alamo Dr to Alamo Crk, and proceeding westerly along Alamo Crk to property line, and proceeding southerly along property line to California Dr, and proceeding easterly along California Dr to property line, and proceeding southerly along property line to nonvisible boundary, and proceeding southerly along nonvisible boundary to the point of beginning.

6. District 6. The region bounded and described as follows:

All of that portion of Solano County bounded and described as follows: Beginning at the point of intersection of Peabody Rd and the Vacaville city line, and proceeding northerly along Peabody Rd to Alamo Dr, and proceeding easterly along Alamo Dr to Leisure Town Rd, and proceeding southerly along Leisure Town Rd to canal/aqueduct, and proceeding easterly along canal/aqueduct to the Vacaville city line, and proceeding southerly along the Vacaville city line to the Fairfield/Vacaville city line, and proceeding westerly along the Fairfield/Vacaville city line to the Vacaville city line, and proceeding northerly along the Vacaville city line to the point of beginning.

7. A map showing the districts described herein (the “District Boundary Map”) is incorporated herein and shall be maintained by the City Clerk and shall be made available to the public. Changes in the boundaries of any district adopted by ordinance shall be reflected on the District Boundary Map in a timely manner. To the extent there is a conflict between the descriptions contained in the ordinance codified in this chapter and the District Boundary Map, the District Boundary Map shall prevail. If necessary to facilitate the implementation of this chapter, the City Manager or his or her designee is authorized to make technical adjustments to the district boundaries that do not substantively affect the populations in the districts or the eligibility of candidates. The City Manager shall consult with the City Attorney concerning any technical adjustments deemed necessary and shall advise the City Council of any such adjustments required in the implementation of the districts.

C. A map showing the districts described in this chapter is attached to the ordinance codified in this chapter as Attachment 1 and incorporated by this reference.

D. The districts specified in subsection B of this section shall continue in effect until they are amended or repealed in accordance with applicable law.

E. Notwithstanding any other provision of this section, and pursuant to California Elections Code Sections 21606(a) and (b), each of the Councilmembers currently in office at the time the ordinance codified in this section takes effect shall continue in office until the expiration of the full term to which he or she was regularly elected or appointed. Any vacancy in or recall election for a Council term currently in effect shall be filled based on the Council districts in effect at the time the current Council term was last regularly elected.

2.60.025 Annexation.

A. Except as set forth in subsection B of this section, any areas annexed into the City shall be added to the adjacent district unless such addition would result in one or more districts to be out of compliance with federal and state law.

B. If any areas in parcels identified as APN Nos. 124-143-02, -03, -04, -05, -06, -07, -08, -09, -10, -11, -24 or 125-040-11 are annexed before the next redistricting, any areas north of the centerline of Fruitvale Avenue shall be in District 5 and any areas south of Fruitvale Avenue shall be in District 1, unless such additions would result in one or more districts to be out of compliance with federal and state law. Such an annexation and assignment of areas to Districts 1 and 5 would not make a material change to the population deviation among all districts and the districts would continue to meet the criteria specified in Elections Code Section 21601.

2.60.030 Election schedule.

A. Councilmembers from Districts 1, 3, and 5 shall be elected at the general municipal election in November 2020 and every four years thereafter.

B. A Councilmember from District 6 shall be elected at the general municipal election in November 2020 for a two-year term.

C. Councilmembers from Districts 2, 4, and 6 shall be elected at the general municipal election in November 2022 and every four years thereafter.

D. In the event a City Council vacancy occurs in a seat held by a Councilmember elected at-large, the seat shall be filled on a by-district basis as follows:

1. The first at-large vacancy shall be filled by appointment or special election, as set forth in Government Code Section 36512 et. seq., by a person qualified to hold the office who lives in District 2. If a special election is called to fill the vacancy, only registered voters of District 2 shall be eligible to vote to fill the vacated Council seat.

2. A second at-large vacancy shall be filled by appointment or special election, as set forth in Government Code Section 36512 et. seq., by a person qualified to hold the office who lives in District 4. If a special election is called to fill the vacancy, only registered voters of District 4 shall be eligible to vote to fill the vacated Council seat.

Once an at-large seat transitions to a by-district seat due to filling a vacancy as set forth above, the City Council seat shall remain as a by-district seat and any further vacancy in that office shall be filled on a by-district basis and consistent with the procedures set forth in Government Code Section 36512 et seq.

2.60.040 At-large election system for Mayor.

Pursuant to Government Code Section 34871(c) and Government Code Section 34900 et seq., the Mayor shall be elected at-large consistent with the results of the November 1976 election based on Resolution No. 1976-K-3.
