9.40.010 Discharge prohibited.

Except as otherwise provided in this chapter, no person shall fire or discharge, or cause to be fired or discharged within this city, nor shall any parent, guardian or person having the care, custody or control of any minor permit such minor to have in his possession within this city, or to fire or discharge or cause to be fired or discharged within the city, any firearm, cannon, fireworks, gun, pistol, revolver, anvil, firecracker or explosive of similar nature, rifle, air rifle, airgun, BB gun or pellet gun, crossbow, bow and arrow, or any instrument of any kind, character or description which throws or projects bullets or missiles of any kind to any distance by means of elastic force, air or any explosive substance, all referred to in this section as “firearms.” (Ord. 900 (part), 1976: prior code §14.22).

9.40.020 Exceptions.

The provisions of Section 9.40.010 as to the use of any of the firearms mentioned therein shall not apply to any of the following cases:

A. To police, peace officers or persons in military service in the discharge of their duties and using reasonable care;

B. To persons using firearms in necessary self defense;

C. To the possession of such firearms for keeping at the place of residence or business of the person otherwise in lawful possession thereof, or while traveling to or from a legal firing, shooting or target range or hunting ground;

D. To the discharging or firing of such firearms or causing them to be discharged or fired at a legal firing, shooting or target range or hunting ground;

E. To the use of a firearm, only upon written permit applied for and granted by the chief of police to protect life, property or livestock against animals, birds, or rodents, and then, only as to the type of firearm specified in said permit;

F. Guards or messengers of common carriers, banks or other financial institutions while actually employed in and about the shipment, transportation or delivery of any money, treasure bullion, bonds or other things of value;

G. Private investigators, private patrol operators and operators of a private patrol service who are licensed pursuant to the Business and Professions Code of the state of California and while acting within the course and scope of their employment;

H. Uniform security guards, regularly employed and compensated as such by persons engaged in any lawful business, while actually engaged in protecting and preserving the property of their employers;

I. Building guards and night watchmen employed by any public agency while acting within the scope and in the course of their employment;

J. Animal-control officers, regularly compensated as such by a governmental agency when acting in the course and scope of their employment;

K. The discharge or shooting of a firearm at a demonstration or exhibition authorized and operated with written permission of the chief of police. (Ord. 900 (part), 1976: prior code §14.23).

9.40.030 Penalty for violation.

Any person violating any provision of this chapter shall be guilty of a misdemeanor and upon conviction thereof shall be subject to a fine or imprisonment, or both. (Ord. 1769, Amended, 09/12/2006; Ord. 900 (part), 1976: prior code §14.24).
