SALE AND DISPLAY OF DRUG PARAPHERNALIA

9.50.010 Sale and display of drug paraphernalia to minors.
No owner, manager, proprietor or other person in charge of any room or space in any place of business open to the public, shall sell, display, cause to be sold or displayed or allowed to be sold or displayed, to any person under the age of eighteen years, any device, contrivance, instrument or paraphernalia prohibited by Section 11364 of the State of California Health and Safety Code, or any instrument used, designed for use or intended for use in injecting, smoking, ingesting, administering or preparing marijuana, hashish, LSD, PCP, hashish oil, cocaine or any other controlled substance. This section shall not apply to businesses licensed to dispense prescription drugs, nor shall it apply to the sale or dispensation of roach clips, cigarette papers and rollers intended for use in rolling tobacco. 9.50.020 Sale authorized in posted room.
The prohibition set forth in this chapter shall not apply when drug paraphernalia is displayed for sale or offered for sale in a room the entrance to which is posted by a conspicuous sign clearly indicating that drug paraphernalia is displayed for sale or offered for sale therein and that minors may not enter such room unless accompanied by a parent or legal guardian. 9.50.030 Minors excluded.
No person in control of any place of business open to the public shall allow a minor not accompanied by a parent or legal guardian to enter or remain in a room at such place of business in which drug paraphernalia set forth in Section 9.50.010 is displayed for sale or offered for sale. (Ord. 1066 (part), 1980).
9.50.040 Sale to minors prohibited.
No person at any place of business open to the public shall sell drug paraphernalia, as set forth in Section 9.50.010, to a minor. (Ord. 1066 (part), 1980).
9.50.050 Sale and display declared public nuisance.
The display for sale or possession for sale of drug paraphernalia as set forth in Section 9.50.010 in a place of business open to the public, except as permitted in Section 9.50.020 is declared to be a public nuisance and may be abated pursuant to Section 731 of the Code of Civil Procedure of the state of California.
