6.04.010 Request for application of county code.

The county passed the “Animal Control Law of the County of Yolo,” as amended, known as County Ordinance 703, effective November 4, 1975, as amended, and the city requests by ordinance the application of its provisions within the city. (Ord. 2003-04 § 13 (part); prior code § 5-6.101)

6.04.020 Adoption by reference.

The city adopts by reference all part of Chapter 1 of Title 6 of the Yolo County Code, as amended, relating to dogs, as permitted under said code. Such portion of the county code is made a part of this code, as if set forth at length herein, including subsequent amendments or additions thereto. 6.04.030 Penalty fees for violation of animal control law.

Pursuant to Section 6-1.104 of the Yolo County Code, as amended, the city requests by ordinance that the provisions of Section 6-l.607 and 6-1.608 of Chapter 1, Title 6 of the Yolo County Code, as amended, which govern penalties for failure to have dogs properly licensed shall apply within the boundaries of the city. Said sections are adopted by reference and are set forth in full as follows:

A.    The owner of any dog required to be licensed who fails to procure and pay for such license until after February 15th of any year, shall nevertheless procure a license for such dog until January 1st next ensuing and, except as otherwise provided in Section 6-l.608 of Chapter 1, Title 6 of the Yolo County Code, as amended, shall pay in addition to the license fee a penalty in the sum of five dollars ($5.00).

B.    The owner of any dog required to be licensed by this section for the year immediately preceding the year in which an application for a dog license is filed, who failed to obtain a license for that dog for that year, shall pay in addition to any other license fee or penalty, a penalty of five dollars ($5.00). 6.04.040 Exceptions from penalties for violation of animal control law.

A.    The penalty provided for in Section 6.04.030 for the non-payment of a license fee on or prior to February 15th of any year shall not apply to the owner of a dog required to be licensed that has not been subject to the licensing requirement for more than ten (10) days.

B.    The penalty provided for in Section 6.04.030 for the non-payment of a license fee for the immediately preceding year shall not apply to the owner of a dog required to be licensed that had not been subject to the licensing requirement for more than ten (10) days during the immediately preceding year. 6.04.050 Cats.

No owner of a domestic cat shall permit or suffer such cat to damage property, public or private or real or personal, or to bite scratch or claw any human being or other animal which is the property of another. (Prior code § 5-6.105)

6.04.060 Running at large.

It is unlawful for any horse, mule, jack, jennet, sheep, goat, hog or horned animal to run at large within the city. This shall be considered a nuisance which may be immediately abated by the police department. (Prior code § 5-6.201)

6.04.070 Herding.

It is unlawful for any person to allow any animals under his or her custody to run at large within the city, or to herd, tie or picket any such animals in any street or public place in the city. (Ord. 2003-04 § 13 (part); prior code § 5-6.202)
