5.28.010 Applicability.
Persons keeping a place for the purchase or sale of secondhand clothing; secondhand household goods; antique furniture or other antique articles; secondhand books, magazines, newspapers and other publications; secondhand jewelry, watches, gold, silver and other precious stones or metals, including American and foreign coins; or any other secondhand personal property of any description, shall be governed by the provisions of this chapter. It is intended that this chapter shall govern and regulate, among other businesses, the operation of gold and silver exchanges and the like. (Prior code § 14 3/4-1)
5.28.020 Definitions.
As used in this chapter, unless the context otherwise requires:
“Dealer” means any person holding himself out to the public as being engaged in the business of buying, selling or trading any valuable articles.
“Dealer” does not include a person purchasing valuable articles from a retail or wholesale merchant. This section shall apply to all employees, agents or servants of the business.
“Precious or semiprecious metals or stones” means such metals as, but not limited to, gold, silver, platinum and pewter, and such stones as, but not limited to, alexandrite, diamonds, emeralds, garnets, opals, rubies, sapphires and topaz. For the purpose of this chapter, ivory, coral, pearls, jade, manmade stones and such other minerals, stones, or gems as are customarily regarded as precious or semiprecious are deemed to be precious or semiprecious.
“Purchase” means giving money to acquire any valuable article, taking valuable articles in full or part satisfaction of a debt, or taking valuable articles for resale for the purpose of full or part satisfaction of a debt.
“Secondhand and/or valuable article” means any tangible personal property consisting, in whole or in part, of precious or semiprecious metals or stones, whether solid, plated or overlaid, including, but not limited to, household goods, jewelry, newspapers and other publications, watches, United States commemorative medals or tokens, and gold and silver bullion or any other secondhand personal property of any description.
“Secondhand and/or valuable articles” shall also include foreign currency when purchased for more than its face value or foreign exchange value.
“Seller” means any person offering a valuable article for money to any dealer, offering a valuable article in full or part satisfaction of a debt, or offering a valuable article for resale for the purpose of full or part satisfaction of a debt. (Prior code § 14 3/4-1.1)
5.28.030 Purchases from minors prohibited.
It is unlawful for secondhand dealers to purchase from any minor under the age of eighteen (18) years. This section shall apply to all employees, agents or servants of the businesses described in Section 5.28.010. (Prior code § 14 3/4-2)
5.28.040 Retention period.
No dealer in secondhand and/or valuable articles shall expose for sale, or sell or dispose of, any article or articles within thirty. (30) days of the time of purchasing the same, nor until the same have been in or upon the premises wherein the same are offered, exposed or sold, at least thirty (30) days.
American and foreign coins, bullion and other items not bearing identifying marks (serial numbers, initials, inscription, etc.) shall be exempt from the thirty-day retention period. (Prior code § 14 3/4-3)
5.28.050 Altering appearance during retention period prohibited.
No dealer in secondhand and/or valuable articles shall alter the appearance of, or remove any identifying numbers, marks or inscriptions from, secondhand jewelry, watches, gold, silver and other precious stones or metals, including coins both foreign and domestic, during the thirty-day retention period. 5.28.060 Lost or stolen goods.
Every dealer in secondhand and/or valuable articles who shall receive or be in possession of any goods, articles or things which may have been lost or stolen, or alleged or supposed to have been lost or stolen, shall forthwith, on a demand, exhibit the same to any member of the Glendale Police Department. 5.28.070 Records required—Verification of seller’s identity.
A. Every person operating a secondhand store shall keep a record book supplied by the Police Department of all articles purchased by the store, which record book shall be open to inspection by any member of the Police Department at all reasonable hours. When the record book is filled, it shall be sent to the Police Department, whereupon a new book shall be furnished. The record shall include the name and residence of the seller, the date of purchase, the amount paid for the item, the signature of both the seller and the.dealer or agent receiving the’ articles sold, together with a description of the item and any identifying marks (initials, serial number, inscription, etc.) on the article.
B. In determining such information, the dealer or his representative shall verify the name and residence through the presentation of:
1. A valid Colorado driver’s license;
2. A state of Colorado issued identification card;
3. A valid driver’s license, containing a picture, issued by another state;
4. A military identification card;
5. A valid passport;

5.28.080 Violation—Penalty.
Upon conviction of a violation of any regulation set forth in this chapter, there shall be imposed a penalty as specified in Section 1.16.010. (Prior code § 14 3/4-7)
