OPTIONAL PREMISES LIQUOR LICENSE

5.38.010 Purpose.
It is the purpose of this chapter for the city of Glendale to exercise its local option under C.R.S Section 12-47-310 to have specific standards for the issuance of optional premises licenses. (Ord. 2007-9 § 1 (part))
5.38.020 Authority.
The City Council, acting in its capacity as the local liquor licensing authority, shall be authorized to issue to qualified applicants the following types of alcohol beverage licenses: hotel and restaurant license with optional premises; and optional premises license. (Ord. 2007-9 § 1 (part))
5.38.030 Requirements.
Such licenses may be issued to applicants meeting the requirements for the respective licenses set forth in the Colorado Liquor Code, C.R.S. Section 12-47-101 et seq., and the regulations promulgated thereunder. (Ord. 2007-9 § 1 (part))
5.38.040 Types of facilities eligible.
The types of outdoor sports and recreational facilities which shall be eligible to apply for an optional premises license or for a hotel and restaurant license with optional premises shall include, without limitation, the following: stadiums and arenas which offer sporting events. 5.38.050 Optional premises areas limit.
No licensee shall have more than ten (10) optional premises areas on any outdoor sports or recreational facility. (Ord. 2007-9 § 1 (part))
5.38.060 Minimum size requirement.
There shall be no minimum size requirement for an optional premises area. (Ord. 2007-9 § 1 (part))
5.38.070 License entitlements.
An optional premises license and a hotel and restaurant license with optional premises shall entitle the holder thereof to serve and sell alcohol up to a maximum of three hundred sixty-five (365) days per year, from 7:00 a.m. in the morning until 2:00 a.m. the next day, unless the days and/or times of service of alcohol beverages are changed or restricted pursuant to:
A. Agreement between the city of Glendale, or one of its departments, and the holder of the alcohol beverage license; or
B. Pursuant to the order of the City Council acting in its capacity as the local liquor licensing authority. (Ord. 2007-9 § 1 (part))
5.38.080 Issuance.
No applicant shall be issued an optional premises license or a hotel and restaurant license with optional premises unless the applicant’s plans for ensuring compliance with the Colorado liquor laws are satisfactory to the City Council, acting in its capacity as the local liquor licensing authority. 5.38.090 Infinity Park.
With respect to any optional premises license held or to be held by the city of Glendale for the premises known as Infinity Park, including related optional premises areas, the oversight, management, and control of the service, sale and consumption of alcohol and nonalcohol beverages and food at Infinity Park shall be the exclusive responsibility of the City Manager of the city of Glendale, including his designees, if any. The City Council of the city of Glendale hereby expressly delegates its authority for such oversight, management, and control to the City Manager of the city of Glendale. The City Council shall not subsequent to the enactment of the ordinance codified in this section be involved in the management, oversight, control, or day-to-day operations at Infinity Park relating to the serving, sale, or consumption of food and beverages, including alcohol and nonalcohol beverages.
