8.08.010 Burglary/holdup/intrusion alarm device defined.
A “burglary/holdup/intrusion alarm device” is a device designed to cause police response, investigation and safeguarding of life and property at the location of an event reported by a signal transmitted, telephoned, radioed, or otherwise relayed to the police/fire communications center by an alarm device or by any person acting in response to a signal activated by such a device. 8.08.020 Service and use agreement.
All users of any device as defined in Section 8.08.010 of this chapter, which is directly monitored at the police/fire communications center, shall execute a service and use agreement with the city of such form and content as adopted by the City Council. (Prior code § 2 1/2-12)
8.08.030 False alarms—Warning—Fees.
Whenever the Police Department of the city has responded to a signal activated by a burglary/holdup/intrusion alarm device, as defined in Section 8.08.010 and it appears, after proper investigation, that no unlawful intrusion on the premises in which the device is located did occur or unavoidable mechanical failure did cause such false alarm, then the owner(s) of the business shall be subject to a written warning issued by the Chief of Police for the first occurrence and to a twenty-five dollar ($25.00) false alarm service fee for each and every occurrence thereafter. This fee shall be payable at the office of the City Clerk no later than thirty (30) days following the date of occurrence of the false alarm. (Prior code § 2 1/2-13)
8.08.040 False alarms—Documentation.
Written documentation shall be provided by the Police Department to the office of the City Manager on each false alarm which shall be subject to a written warning or the false alarm service fee. A written demand for payment of each false alarm service fee shall be mailed to the violator by the Chief of Police within five (5) days following the occurrence. (Prior code § 2 1/2-14)
8.08.050 Failure to pay service fee or abide by service and use agreement.
The failure to pay any false alarm service fee or failure to abide by the terms and conditions of the service and use agreement shall result in a refusal to provide or discontinuation of burglary/holdup/ intrusion alarm monitoring service by the city to those direct line users. In addition, the city may maintain an action for the fee and all costs of collection, including reasonable attorney’s fees. (Prior code § 2 1/2-15)
