12.25.010 General purpose.
The general purpose of the ordinance codified in this chapter is to allow specific term occupancy permits for public rights-of-way in areas designated by the City Manager. (Ord. 2014-7 § 1 (part))
12.25.015 Designation of right-of-way.
A. The Public Works Director may recommend to the City Manager a designated portion of the right-of-way for availability of occupancy permit after considering the following factors:
1. Width of right-of-way;
2. Need for additional parking from adjacent properties;
3. Traffic volume in right-of-way;
4. Access of fire suppression equipment, as determined by the Fire Marshal; and
5. Right-of-way use and access by public utilities.
B. The City Manager, after reviewing the Public Works Director’s recommendation, may designate a portion of the right-of-way to be temporarily available for occupancy of exclusive vehicle parking. (Ord. 2014-7 § 1 (part))
12.25.020 Notice of application process.
The City Manager shall notify adjacent property owners of the availability of the designated right-of-way by regular mail at least twenty (20) days prior to the deadline for accepting applications. (Ord. 2014-7 § 1 (part))
12.25.030 Permit—Application.
Applicants for an exclusive vehicle parking occupancy permit shall file an application with the Public Works Director on forms to be provided for that purpose. The application shall be accompanied by the following information:
A. Name and address of the applicant;
B. The parking need demonstrated by the applicant;
C. Requested months that the parking will be required;
D. Site plan showing the location of all parking spaces, striping plan, signage to be installed, and compliance with all required fire lanes for all adjacent structures;
E. Description of proposed operation of the proposed parking on the designated right-of-way, which shall include control of unauthorized parking and removing cars parked at unauthorized times; and
F. Evidence that the applicant has been or will be issued liability insurance coverage in such amount as the office of City Manager deems necessary, with the city of Glendale named as an additional insured. (Ord. 2014-7 § 1 (part))
12.25.040 Review and inspection.
Before issuing an exclusive vehicle parking occupancy permit, the City Manager shall review the following:
A. All applications for completeness as described in Section 12.25.030. Only applications that are complete shall be reviewed.
B. The application for compliance with all other ordinances and regulations of the city of Glendale, with the aid of the Public Works Director, Building Official, Fire Marshal, and Police Chief.
C. If more than two (2) applications are submitted and approved for a particular designated right-of-way, the City Manager shall determine the allocation to applicants by the following factors:
1. Proximity of the designated area to the applicant’s property;
2. The need based on existing zoning code for the parking requested;
3. The length of time the applicant is requesting the parking; and
4. The design and operational details of the applicant’s submittal. (Ord. 2014-7 § 1 (part))
12.25.050 Effect of disapproval.
If the office of the City Manager disapproves an application, no exclusive parking occupancy permit shall be issued. (Ord. 2014-7 § 1 (part))
12.25.060 Requirements for issuance.
A permit may be issued under this chapter, subject to the following requirements:
A. Approval of the application by the office of City Manager;
B. Proof of liability insurance coverage in the amount approved by the City Manager, with the city of Glendale named as an additional insured;
C. Payment of the monthly per-parking space fee for an exclusive parking occupancy permit issued under this chapter in the amount of thirty dollars ($30.00) for the months with all-day use and twenty dollars ($20.00) for months with limited use;
D. A signed operational agreement covering the following:
1. The period of time for which the permit is issued and the date operation is to begin;
2. Map of the parking area and an agreement to permanently remove all paint and signs upon expiration of the permit;
3. The operational requirements as requested by the City Manager, including, but not limited to, no overnight parking from October to April, signage of parking spaces, scheduling for city street sweeping and maintenance, and removal of cars as needed by the agreement;
4. A statement that the permit is subject to the provisions of this chapter and shall conform to operational requirements required by the City Manager; and
5. A statement that the permittee shall hold the city harmless from any liability;
E. Ensure that all other necessary licenses or permits have been issued, including sales tax licenses and County Health Department approval, where applicable. (Ord. 2014-7 § 1 (part))
12.25.065 Renewal.
The permit may renew for up to two (2) additional one (1) year periods. (Ord. 2014-7 § 1 (part))
12.25.070 Revocation.
A permit may be revoked for the following reasons:
A. Violation of the provisions of the operational agreement;
B. Failure to pay the fees owed under the permit for more than sixty (60) days;
C. Cancellation of the required liability insurance policy if said cancellation is not remedied within ten (10) days after the date of cancellation; and
D. By purpose to preserve the public safety or improve traffic flow in the city. (Ord. 2014-7 § 1 (part))
