2.80.010 Creation of planning commission.
There is hereby created a planning commission of the town of Granby, Colorado, consisting of seven members, which shall have all of the powers and duties prescribed by and for municipal planning commissions by the statutes of the state of Colorado. In addition, the board of trustees may, but shall not be obligated to, appoint one or more alternate members, as it deems appropriate, to serve until such appointment is terminated by the board or the alternate member resigns. Such alternate member(s) are authorized to participate as a regular planning commission member in the event any duly appointed regular planning commission member does not attend a planning commission meeting. 2.80.020 Members and terms of office.
(a) All members shall be residents of the town. If any member ceases to reside in the town, his/her membership on the commission shall automatically terminate.
(b) The members of the planning commission and their term of office for each are as follows:
(1) The mayor or mayor pro-tem, who shall serve during his/her term of office.
(2) One member of the board of trustees appointed by the board, or if no board member is interested, a citizen shall serve for a two-year term.
(3) Five citizens appointed by the board of trustees to serve for four-year terms. [Ord. 719 § 2, 2008. Code 1999 § 17-1-2].
2.80.030 Vacancies.
Vacancies occurring other than through the expiration of term shall be filled for the remainder of the unexpired term by the board of trustees in the same manner as the original appointment. A vacancy is created:
(a) If the person who was duly appointed, except for the mayor, fails to attend three consecutive regular and convened meetings of the commission without the commission having entered upon its minutes an approval for an additional absence or absences; except that such additional absence or absences shall be excused for temporary mental or physical disability or illness, or in the event the meetings were never held.
(b) If the person who was duly elected or appointed dies during his/her term of office or becomes mentally or physically incapacitated. [Ord. 719 § 2, 2008. Code 1999 § 17-1-3].
2.80.040 Powers and duties of planning commission.
(a) It is the duty of the commission to make and adopt a master plan for the physical development of the town including any areas outside its boundaries, subject to the approval of the governmental body having jurisdiction thereof, which, in the commission’s judgment, bear relation to the planning of the town. Such plan, with the accompanying maps, plats, charts, and descriptive matter, shall show the commission’s recommendations for the development of said territory, including, but not limited to:
(1) The general location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks, aviation fields, and other public ways, grounds and open spaces;
(2) The general location and extent of public utility corridors and terminals, whether publicly or privately owned or operated, for water, light, sanitation, transportation, communication, power and other purposes;
(3) The removal, relocation, widening, narrowing, vacating, abandonment, change of use, or extension of any of the ways, grounds, open spaces, buildings, property, utility, or terminals referred to in subsections (a)(1) and (2) of this section; and
(4) A zoning plan for the control of the height, area, bulk, location, and use of buildings and premises.
(b) As the work of making the whole master plan progresses, the commission may from time to time adopt and publish a part thereof. Any such part shall cover one or more major sections or divisions of the town or one or more of the foregoing or other functional matters to be included in the plan. The commission may amend, extend, or add to the plan from time to time.
(c) In the preparation of such plan, the commission shall make careful and comprehensive surveys and studies of present conditions and future growth of the town with due regard to its relation to neighboring territory. The plan shall be made with the general purpose of guiding and accomplishing a coordinated, adjusted, and harmonious development of the town and its environs which will, in accordance with present and future needs, best promote health, safety, morals, order, convenience, prosperity, and general welfare, as well as efficiency and economy in the process of development. The plan shall include, among other things, adequate provision for traffic, the promotion of safety from fire, flood water, and other dangers, adequate provision for light and air, the promotion of healthful and convenient distribution of population, the promotion of good civic design and arrangement, wise and efficient expenditure of public funds, and the adequate provision of public utilities and other public requirements.
(d) The commission shall recommend the drafting and adoption of subdivision regulations for the town. It shall continually update and review the subdivision regulations for harmony with the purposes of said regulations and the growth of the town.
(e) The commission is responsible for making investigations and reports on the design and improvement of proposed subdivisions and requiring conformity of such subdivisions with the master plan for the town, state statutes, and this chapter, utilizing the assistance and cooperation of elected and appointed officials of the town, the county and the state, as well as the services of consultants when required. No plat of a subdivision of land shall be filed and recorded until it has been approved by the commission and such approval indicated by the signatures of the chairperson on the final plat.
(f) The commission shall recommend such changes to the relevant ordinances and other regulations, as it may deem desirable to aid in accomplishing its assigned duties.
(g) The commission shall perform all other duties assigned to it by the board of the town and shall have all other powers and duties granted to it by Colorado statutes and the rules and regulations promulgated thereunder.
(h) The commission shall have the right to prepare a master street plan for the area under its subdivision control, including a street numbering system. [Ord. 719 § 2, 2008. Code 1999 § 17-1-4].
