8.40.010 Definitions.
As used in this chapter, the following terms shall have the meanings indicated:
“Hazardous materials” means any hazardous materials as defined or listed by any state of Colorado or federal statute or regulation.
“Liquid waste” means such substances as wastewater, fats, oils or grease (FOG), used oil, chemicals, petroleum, paints, stains, sewage, sludges or any industrial, commercial or household liquids.
“Solid waste” means garbage, trash, litter, junk, plastic materials, treated lumber, or materials no longer used for their intended purpose. [Ord. 971 § 1, 2022].
8.40.020 Unlawful acts.
(a) It shall be unlawful for any person or entity to knowingly, willfully or intentionally discharge, deposit, drain or bury any liquid waste, solid waste, or hazardous materials on or into the ground at or on any property that causes an environmental, wildlife, health, or safety hazard.
(b) It shall be unlawful for any person or entity to knowingly, willfully or intentionally burn or incinerate chemicals, plastic, liquid waste, treated lumber, garbage, trash, hazardous materials, or any substance that adversely affects the senses or causes an environmental, wildlife, health or safety hazard.
(c) It shall be unlawful for any person or entity to knowingly, willfully or intentionally discharge, deposit, or place any liquid waste, solid waste, or hazardous materials into any body of water. [Ord. 971 § 1, 2022].
8.40.030 Cease and desist.
In addition to the penalties provided for in GMC 8.40.040, the town manager will have the authority to impose a cease and desist order or a stop work order in the event of a violation of this chapter which presents an immediate risk or danger to the health, safety or welfare of the public or of property within the town.
