16.05.010 Title.
This title may be cited as the Granby zoning code and map, as amended. [Ord. 719 § 1, 2008. Code 1999 § 16-1-1].
16.05.020 Authority.
This title is authorized by Article 31-23-301, et seq., C.R.S. [Ord. 719 § 1, 2008. Code 1999 § 16-1-2].
16.05.030 Purpose.
The regulations and restrictions established herein have been made in accordance with the Granby master plan which plan is designed to:
(a) Lessen congestion in the streets;
(b) Secure safety from fire, panic and other dangers;
(c) Promote health, morals, order and the general welfare of present and future inhabitants;
(d) Provide adequate light and air;
(e) Prevent the overcrowding of land;
(f) Avoid undue concentration of population;
(g) Facilitate adequate provisions for transportation, water, sewage, schools, parks, and other public requirements;
(h) Preserve natural amenities and desirable characteristics of the land while providing for progress;
(i) Provide for division of the town into compatible districts.
Such regulations have further been made with reasonable consideration as to the character of each district and its particular suitability for particular uses with a view toward conserving the value of land and buildings, encouraging the most appropriate use of land throughout the town, and the protection of the town’s tax base. 16.05.040 Application.
The provisions of this title shall be effective within the incorporated limits of the town and shall apply to all persons, entities, corporations, governmental agencies, state governments, federal governments, local governments, municipal and quasi-municipal corporations. 16.05.050 Interpretation of language.
For the purpose of these regulations, words used in this section shall be interpreted in accordance with the rules set forth below:
(a) The particular controls the general.
(b) In case of any difference of meaning or implication between the text of these regulations and the captions for each section, the text shall control.
(c) The word “shall” is always mandatory and not permissive. The word “may” is permissive.
(d) Words used in the present tense include the future, unless the context clearly indicates the contrary.
(e) Words used in the singular include the plural, and words used in the plural include the singular, unless the context clearly indicates the contrary.
(f) The word “person” includes a corporation, limited liability company, partnership, limited partnership, limited liability limited partnership, or other entity, as well as an individual. [Ord. 719 § 1, 2008. Code 1999 § 16-1-5].
16.05.060 Interpretation.
The provisions of this chapter shall be interpreted and applied to be the minimum required for the proper protection of the public health and the promotion of safety and general welfare in the town. [Ord. 719 § 1, 2008. Code 1999 § 16-1-6].
16.05.070 Conflicts.
Wherever the requirements contained in this title are at variance with the requirements of any other lawfully adopted rules, regulations or ordinances, or provisions of this code, the one which is more restrictive, or which requires the higher standard, shall apply.
