2.45.010 Created.
A fire department in and for the village of Donnelly is hereby created. [Ord. 11 § 1, 1952.]
2.45.020 Department to consist of volunteer fire companies.
Said fire department shall consist of such voluntary fire companies as may be hereafter organized in said village in accordance with the provisions of this chapter. [Ord. 11 § 2, 1952.]
2.45.030 Volunteer fire companies – Equipment and members.
Said department shall consist of not to exceed one company for each fire engine, chemical engine, hose cart, and hook and ladder truck owned by said village. Each company shall consist of not less than eight and not more than 20 members. [Ord. 11 § 3, 1952.]
2.45.040 Officers.
The officers of said fire department shall be one chief of the fire department, one assistant chief of the fire department, one secretary and one treasurer of the fire department, and one foreman and one assistant foreman of each company. [Ord. 11 § 4, 1952.]
2.45.050 Election of officers.
The chief, assistant chief, secretary and treasurer of the fire department shall be elected by the vote of all the members of the department, and the foreman, assistant foreman and other company officers shall be elected by the vote of the members of their company. [Ord. 11 § 5, 1952.]
2.45.060 Authority of chief and assistant chief.
The chief of the fire department shall preside at all the meetings of the members of the department, and, when on duty at a fire, shall have full and absolute direction, management and control of all members of said department, all voluntary helpers at such fire, and of all fire fighting property, apparatus and machinery owned or used by said village.
In case of the absence or inability of the chief of the fire department to perform any of his duties, the assistant chief of the fire department shall act as chief with equal power and authority, and in case both chief and assistant chief are absent, the oldest foreman present shall act as chief during such absence. The foreman shall be commanding officer of his company. The assistant foreman shall render such assistance as may be required of him by his foreman, and in the foreman’s absence or inability to act shall act as foreman. [Ord. 11 § 6, 1952.]
2.45.070 Election, term of office, rules and regulations.
All officers of the department shall be elected from and by the members of the department at a meeting of the members to be held during the month of May of each year hereafter, and shall hold office for a period of one year until their successors shall have been duly elected and installed. The first officers of the department shall be elected at a meeting of the members of the department to be held within 30 days from and after the adoption of this chapter, and shall hold office until their successors are elected and take office as hereinabove provided. The department may make such rules and regulations for its government as shall not be inconsistent or in conflict with the Constitution and laws of the state of Idaho or with the ordinances of this village. 2.45.080 Special police officer powers and authority.
When in the performance of their duties in fighting fire, or in protecting property either during or after any fire, the members of said fire department shall be special police officers of the village of Donnelly, and shall have all the powers and authority conferred by law on police officers. [Ord. 11 § 8, 1952.]
2.45.090 Liability.
No liability incurred by the fire department or any officer or company thereof shall be a charge against the village unless first authorized by the board of trustees of such village. [Ord. 11 § 9, 1952.]
