8.15.010 Requirements for snow and/or slush and/or ice.

No owner, manager, or tenant of property abutting concrete sidewalks shall place or suffer to remain in place for more than 24 hours after the cessation of such a storm any slush, ice, or any loose, granular, or packed snow upon such sidewalk. Removal of any slush, ice, or snow should be conducted along the full paved width of such sidewalk and in a manner that ensures the orderly flow and safety of pedestrian traffic upon such sidewalks. Furthermore, owners of open parking lots shall not remove snow, ice or slush in such a manner that interferes with clear vision triangles regarding ingress and/or egress from said parking lots. Each day that a violation exists shall be considered a separate and distinct violation. [Ord. 203 § 1(a), 2009.]

8.15.020 Depositing snow in city streets.

Snow removed from sidewalks or walkways on Donnelly City Main Street may be deposited on the city street adjacent to the sidewalk. [Ord. 203 § 1(b), 2009.]

8.15.030 Regulating snow and/or slush and/or ice and/or mud removal from sidewalks and private property.

A. No person shall remove slush, snow, or ice from any driveways, paths, buildings, structures, roofs or any other privately owned real property and place it upon any sidewalk, right-of-way or public street in the city except pursuant to DCC 8.15.020.

B. Any violation of DCC 8.15.010, 8.15.020 or subsection (A) of this section shall result in an infraction and shall be punished by a fine not to exceed $100.00 for each such violation. [Ord. 203 § 1(c), 2009.]

8.15.040 Snow removal by city.

In the event that the owner of any such abutting property shall fail to remove or cause to be removed, or in the event that such accumulation shall remain upon city sidewalks in violation of the provisions of this chapter, then it shall be removed by the officials of the city and the costs of such removal shall be assessed against the property of the owner. 8.15.050 Collection of costs.

When cost has been incurred under the provisions of this chapter, the city clerk may certify such assessment to the proper county officials having charge of the making up of the assessment roll for the city, that such assessment may be placed on such roll for collection in the same manner as other city taxes are collected. The city clerk may also use any available legal means to collect such assessment. [Ord. 203 § 1(e), 2009.]
