5-124-010 Definitions.

In all cases where the words “wholesale,” “wholesaler,” and “wholesale dealer” are used in this chapter, unless otherwise specifically defined, they shall be understood and held to relate to the sale of goods, merchandise, articles or things in quantity to persons who purchase for the purpose of resale, as distinguished from a retail dealer who sells in smaller quantifies direct to the consumer. 5-124-020 License required.

It is unlawful to engage in the business of wholesale provision dealer, or to buy and sell at wholesale as that term is defined in Section 5-124-010, any meat, poultry, fish, butter, cheese, lard, vegetables, fruit, flour, meal, or other provisions without first having obtained a license therefor. 5-124-030 Applications for license.

Applications for such licenses shall conform to the general provisions in this code relating to such applications; and in addition to the information therein required, each such application shall state thereon the premises to be used for the business and the number and description of the vehicles used or to be used in the transportation of such food or provisions, if any. 5-124-040 Investigation.

Each such application shall be referred to the health officer before the license requested is issued. He shall make or cause to be made an investigation into the premises and vehicles to be used for the storage or transportation of such food or provisions, and shall report his findings to the clerk, with a recommendation that the license be issued or denied. No such license shall be issued without the approval of the health officer excepting on order of the mayor. (Prior code § 5-44-4)

5-124-050 Fee.

The annual license fee shall be based on the number of employees as laid out in Chapter 3-01, Fees, Fines, Insurance and Guarantee Requirements. (Ord. 3494 § 2(B), 2024; prior code § 5-44-5)

5-124-060 Storage.

All premises or places used by such licensees for the storage of food or provisions shall be kept in a clean and sanitary condition; and all such places shall be kept free from rodents and vermin. It is unlawful to permit any animal to remain in any room used for such purposes. (Prior code § 5-44-6)

5-124-070 Vehicles.

All vehicles used for the transportation of food or provisions in connection with such business shall be kept in a clean and sanitary condition. (Prior code § 5-44-7)

5-124-080 Unwholesome food.

It is unlawful to keep or store, in connection with such business, or to sell or offer for sale, any food or provisions intended for human consumption which is spoiled, unwholesome or tainted. (Prior code § 5-44-8)

5-124-090 Inspection.

It shall be the duty of the health officer and he is authorized to make or cause to be made such inspections as may be necessary to see to the enforcement of the provisions of this chapter; and he or his authorized deputy shall be given access to every portion of the premises used in such licensed business for the purpose of making such inspection at any reasonable time.
