16-76-010 Purpose.

The purpose of home occupation regulations is to establish standards for individuals who operate businesses from their residential dwelling or premises. The intent of this regulation is to protect residential districts from commercial encroachment, prevent any undue increase in traffic or parking problems and character of the neighborhood. A special application issued by the planning department is required for the conduct of any home occupation. (Ord. 2286 § 24.0, 1982)

16-76-020 Standards.

A.    No person other than a member of the immediate family occupying the dwelling unit shall be engaged in such occupation.

B.    No stock in trade shall be displayed on the premises.

C.    No article shall be sold or offered for sale on the premises except such as is produced by the occupation on the premises.

D.    No mechanical or electrical equipment shall be installed or maintained other than such as is customarily incidental to domestic use.

E.    No equipment or process shall be used in home occupations which create noise, vibration, glare, fumes, odor or electrical, audial or visual interference detectable to the normal senses off of the lot.

F.    No traffic shall be generated by such home occupation that will create greater volumes than would normally be expected in a residential neighborhood.

G.    The home occupation shall be conducted entirely within the principal building that is used as the dwelling. It shall not be conducted in accessory buildings and no outdoor storage shall be permitted.

H.    The home occupation should not change the interior or exterior appearance of the dwelling or premises.

I.    The use of the dwelling or premises for the home occupation shall be clearly incidental and subordinate to its principal use for residential purposes by its occupants.

J.    Signs as permitted in Chapter 16-64.

K.    Off-street parking as permitted in Chapter 16-72.

L.    Offices, clinics, medical, dental and other health care facilities, hospitals, barber shops, beauty shops, dress shops, millinery shops, tea rooms, restaurants, kennels, automobile/truck repair, auto body repair, renting of equipment, private clubs, mortuary, nursery schools or kindergartens and private schools and cannabis business establishments are not considered home occupations.
