SEASONAL AND TEMPORARY USES

16-80-010 Purpose.
The purpose of the seasonal use legislation is to establish regulations for temporary uses in the zoning districts of Harvey. The intent of this provision is to provide guidelines to residents, nonprofit organizations, government entities and private businesses who desire to sell merchandise or personal property on their premises on a nonyear-round basis. 16-80-020 General regulations.
A. Any personal property sale, seasonal merchandise sale or similar temporary sale of goods which interrupts or disturbs the neighborhood or generates excessive traffic in the city will be prohibited.
B. Any person who desires to hold a personal property sale, seasonal merchandise sale or similar temporary sale of goods shall first obtain a permit for such purpose from the planning department.
C. Any officer of the city shall have the right to enter any premises which advertises any sale of personal property, seasonal merchandise or similar temporary sale of good and shall have the right to stop any sale if a violation of this ordinance has or will occur.
D. Advertising of any personal property sale, seasonal merchandise sale or similar temporary sale of goods must comply with sign and setback requirements established for each district.
E. The sale of merchandise, products or produce under any seasonal use permit must comply with all applicable health, sanitation and revenue codes.
F. Extension of the duration of permit must be granted from the city council.
G. The following uses are deemed temporary and shall be subject to conditions listed below:
