2.100.010 Applicability.
The provisions of this chapter shall apply alike to all officers and employees of the village, regardless of the time of the creation of the office or position or the time of the appointment of the officer or employee. The provisions of this chapter shall be applicable to all full-time employees. (Ord. 88-5, 1988)
2.100.020 Appointments.
All officers other than elective officers shall be appointed by the president and the board of trustees, as is provided by statute; provided, that all employees shall, in the absence of any provision to the contrary, be appointed or selected by the village president.
2.100.030 Term of officers – Vacancies.
Every appointive officer of the village shall hold office until the first of May following his appointment, or until his successor is appointed and qualified, unless it is otherwise provided by ordinance. In case of a vacancy in any such place, it shall be filled in the same manner in which appointments or selections are made in the absence of provision to the contrary.
2.100.040 Moneys received.
Every officer of the village shall at least once each month turn over all money received by him, in his official capacity, to the clerk with a statement showing the source from which the same was received.
2.100.050 Oath of office.
Every officer of the village shall, before entering upon his duties, take the oath prescribed by statute.
2.100.060 Bond.
Every officer and employee shall, if required by the board of trustees, upon entering upon the duties of his office, give a bond in such amount and with such sureties as may be determined by the board, conditioned upon the faithful performance of the duties of his office or position.
2.100.070 Salaries.
All officers and employees of the village shall receive such salary as may be from time to time provided by ordinance.
2.100.080 Contributions to Illinois Municipal Retirement Fund Act.
Pursuant to a referendum election heretofore held at which the voters of the village elected to be included in the Illinois Municipal Retirement Fund Act, all nonelected officers and employees of the village on the regular payroll are under the provisions of this Act, and the contributions and payroll deductions prescribed in the Act shall be made pursuant thereto.
2.100.090 Wages for workmen in public works construction.
A. To the extent and as required by the Prevailing Wage Act, the general prevailing rate of wages in the village for laborers, mechanics and other workers engaged in construction of public works is hereby ascertained to be the same as the prevailing rate of wages for construction work in the county of Cook as determined by the Illinois Department of Labor as of June 2015, a copy of said determination being attached to the ordinance codified in this section and made a part hereof as Exhibit A.
B. As required by the Prevailing Wage Act, any and all revisions of the prevailing rate of wages by the Illinois Department of Labor shall supersede said determination and apply to any and all public works and the definition of any terms appearing in this section, which are also used in the Prevailing Wage Act, shall be the same as in the Prevailing Wage Act.
C. Nothing herein contained shall be construed to apply the prevailing rate of wages as herein ascertained to any work except public works or to the extent required by the Prevailing Wage Act.
D. The village clerk shall publicly post and keep available for inspection by any interested party in the main office of the village this determination or any revisions of the prevailing rate of wage.
E. The prevailing rate of wages as determined herein, or as subsequently revised, shall be included in every contract for public work, and all ordinances, resolutions, calls for bids and bid specifications relating to any public work shall state or provide that any person performing any public works on behalf of the village shall be required to pay the prevailing rate of wages to all laborers, mechanics and other workers employed for such public works. All contractors’ bonds, provided by any contractor on any public works for the village, shall provide a guarantee that the contractor will faithfully perform his obligation to pay the prevailing rate of wages as provided by the contract for such projects and in accordance with the Act.
F. The village clerk shall mail a copy of this determination to any employer, and to any association of employers and to any person or association of employees who have filed their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workers whose wages will be affected by such rates. 2.100.110 Military service.
A. Municipality credits shall be provided for any employee of the village who shall leave such employment to serve in the armed services or the women’s auxiliary services of the United States for all periods of such service; provided, that such person returns to active employment with the village within ninety days after discharge from such service, on the assumption that the employee received earnings at the rate received at the time he left the village employment to enter such services.
B. A participant in the armed services or women’s auxiliary services shall not be considered an employee of the village during such service and no additional death or disability benefits are payable for death or disability during such absence as provided by statute.

2.100.130 Assignment of duties.
The board of trustees shall have the power to assign to any appointive officer any duty which is not assigned by ordinance to some other specific officer, and shall determine disputes or questions relating to the respective powers or duties of officers.
2.100.140 Records.
All records kept by any officer of the village shall be open to inspection by the president, or any member of the board of trustees, at all reasonable times, whether or not such records are required to be kept by statute or ordinance.
2.100.150 Termination of office.
Every officer and employee of the village, upon the expiration of his term for any cause whatsoever, shall deliver to his successor all books and records which may be the property of the village, and if no successor has been appointed within one week after the termination of office, such property shall be delivered either to the village clerk or village treasurer.
2.100.160 Inspections by village officers.
A. Any officer or employee of the village who is authorized to enforce ordinances may make such inspections, and issue municipal tickets and notices of violation, as may be necessary to see to the enforcement of and penalization for violation of such ordinances.
B. Whenever such officer or employee shall have reason to believe that there exists on or in any premises in the village any nuisance dangerous to public health, any fire hazard, any structural defect likely to result in injury to person or property, or any electric wiring or equipment in such condition as to present a fire hazard or danger to persons, he shall ask permission of the occupant of such premises, or the owner or custodian thereof, if the premises are unoccupied, to inspect the same.
C. Each such occupant or owner shall permit such inspection at any reasonable time. Any such owner or occupant who refuses to permit such inspection shall be fined not less than fifty dollars nor more than five hundred dollars for each offense.
D. Any officer or employee of the village who is authorized to enforce any village ordinance may issue municipal tickets and notices of violation for any illegally parked vehicle, including but not limited to vehicles parked in a manner that violates Chapter 10.60 RMC, and may issue municipal tickets and notices regarding anticipated impoundment as provided by RMC 10.76.050, Abandoned/junk vehicles.
E. Any officer or employee of the village who is authorized to enforce any village ordinance may issue municipal tickets for violations of RMC 10.84.060, Pedestrians walking along roadways. (Ord. 2010-16 § 1, 2010)
2.100.170 Power to make arrests.
The village president, village trustees and members of the police department, are declared to be conservators of the peace with such powers to make arrests as are given to conservators of the peace by statute.
2.100.180 Peace officer defined – Power to make arrests.
A. “Peace officer” means any person who, by virtue of his office or public employment, is vested by law with a duty to maintain public order or to make arrests for offenses, whether that duty extends to all offenses or is limited to specific offenses.
B. The health inspector, superintendent of public works or duly authorized employee of the department of public works shall be a peace officer as defined in subsection A of this section.
C. Whenever a peace officer is authorized to arrest a person without a warrant he may instead issue to such person a notice to appear. The notice shall:
1. Be in writing;
2. State the name of the person and his address, if known;
3. Set forth the nature of the offense;
4. Be signed by the officer issuing the notice; and
5. Request the person to appear before a court at a certain time and place.
Upon failure of the person to appear a summons or warrant of arrest may be issued.
D. All peace officers, as provided in this section, shall enforce all the applicable ordinances of the village.

2.100.210 Reimbursement of hiring and training expenses.
All new police officers hired by the village shall execute an agreement for reimbursement of hiring and training expenses in accordance with a form of agreement attached to Ordinance 95-13, passed 5-9-95 and made a part thereof as Exhibit A. (Ord. 95-13 § 1, 1995)
