8.72.010 Fireworks.

It is unlawful for any person, firm or corporation to sell, keep, expose for sale, loan or give away any toy pistol, toy gun, toy cannon, blank cartridge, or any fireworks, firecrackers, torpedoes, bombs, squibs, rockets, spin-wheels, fire balloons, Roman candles, or detonating canes, or any substance or articles of any explosive nature designed or intended to be used as fireworks, anywhere in the village. 8.72.020 Discharge of fireworks.

It is unlawful for any person, firm or corporation to be possessed of or to discharge anywhere in the village any of the articles enumerated in RMC 8.72.010; provided, however, that the president and board of trustees may issue a permit for the discharge of fireworks and for pyrotechnical displays as provided in RMC 8.72.030. 8.72.030 Fireworks permit – Application and issuance.

Application for permits for the discharge of fireworks or for pyrotechnical displays shall be in writing and shall provide the following:

A. The name and address of the individual or entity hosting the fireworks display;

B. The proposed location of the fireworks display;

C. The type of fireworks display, whether it is a consumer or pyrotechnic display as established by Illinois state statute;

D. The company, including the name of its representative and address, contracted to conduct the fireworks display;

E. Copies of documents related to the fireworks demonstration:

1. The signed contract with the pyrotechnic company;

2. A certificate of liability insurance that must provide minimum general liability coverage of one million dollars;

3. An Alcohol, Tobacco and Firearms license/permit;

4. An Office of the Illinois State Fire Marshal pyrotechnic license;

5. An Office of the Illinois State Fire Marshal operator license;

6. A list of the fireworks selected for the fireworks display;

7. Other pertinent documentation which may be requested by the village.

Such application shall be notarized.

The president shall, upon receipt of such application, refer the same to the chief of police and the chief of the fire department who shall have inspections made of the location given in the application where it is proposed to give such public display of fireworks, and of the fireworks during setup and throughout the display process, and if in the judgment of the chief of police and the chief of the fire department it would not be hazardous to surrounding property or dangerous to any person or persons to permit such public display of fireworks at such location, they shall approve such application and return the same to the president and board of trustees, whereupon the president shall issue a permit upon payment of a fee of fifty dollars. Such permits shall limit the kinds and quantities of fireworks to be used at such public display, and no other kinds and no greater quantities of fireworks than therein specified as part of the application shall be used at such public display. 8.72.040 Nitroglycerine – TNT.

It is unlawful to keep or store any nitroglycerine or the explosive commonly known as TNT in the village in any quantities, excepting for medicinal or laboratory purposes, and for such purposes no more than one-fourth of an ounce shall be stored in any one building or premises.
