OBSTRUCTING PUBLIC OFFICERS

9.08.010 Resisting or obstructing a peace officer.

A person who knowingly resists or obstructs the performance by one known to the person to be a peace officer of any authorized act within his official capacity commits a Class A misdemeanor.

9.08.020 Obstructing service of process.

Whoever knowingly resists or obstructs the authorized service or execution of any civil or criminal process or order of any court commits a Class B misdemeanor.

9.08.030 Obstructing justice.

A person obstructs justice when, with intent to prevent the apprehension of or obstruct the prosecution or defense of any person, he knowingly commits any of the following acts:

A. Destroys, alters, conceals or disguises physical evidence, plants false evidence, furnishes false information; or

B. Induces a witness having knowledge material to the subject at issue to leave the state or conceal himself; or

C. Possessing knowledge material to the subject at issue, he leaves the state or conceals himself.

9.08.040 Impersonation.

A. It is unlawful for any person to impersonate without lawful authority any village officer or employee.

B. No person shall impersonate any of the members of the police department, or shall maliciously, or with intent to deceive, use or imitate any of the signs, signals or devices adopted and used by the police department, or shall wear in public the uniform adopted as the police uniform, after having been removed or suspended.

C. No person, other than a member of the police department, or duly authorized auxiliary policeman, shall assume to act as a policeman in any capacity within the village. (Ord. 99-03, 1999)

9.08.050 Interference with officers.

A. It is unlawful to interfere with or hinder any officer or employee of the village while engaged in the duties of his office or employment.

B. Any person who in the village resists any member of the police duty in the department or any other person duly authorized to perform police duty in the discharge of his duties, or in any way interferes with, prevents or hinders him in the discharge of his duty as such member, or offers or endeavors to do so, and any person who in any manner assists any person in the custody of any member of the police department to escape or attempt to escape from such custody, or attempts to rescue any person from custody, shall be punished as provided in Chapter 1.20 RMC. 9.08.060 Bystanders to obey orders of chief of fire department.

Every person who is present at a fire shall be subject and obedient to the orders of the chief of the fire department and other officers of the fire department in extinguishing a fire and in the removal and protection of property.

9.08.070 Obstructing use of fire hydrant.

No person shall in any manner obstruct the use of any fire hydrant or have or place any material or vehicle in front thereof or within twenty feet from either side thereof. Any and all materials or vehicles found as an obstruction as aforesaid may be removed at the direction of or under the supervision of any member of the fire department when authorized by the person in charge, and at risk, cost and expense of the owner or claimant.
