MOTORCYCLES

10.72.010 Motorcycle defined.
“Motorcycle” means every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor.
10.72.020 Fee.
Each owner or operator of a motorcycle who resides within the village shall pay each year to the village clerk a tax or license fee as provided in Chapter 10.20 RMC for the use of each motorcycle registered at an address within the corporate limits and used on any public street or alley within the village.
10.72.030 Passing other vehicles.
A. The driver of a two-wheeled motorcycle may not pass between two vehicles proceeding in the same direction unless there is an unobstructed lane of traffic available to permit such passing maneuver safely.
B. The driver of a two-wheeled motorcycle is prohibited from passing on the right side of any other vehicle proceeding in the same direction unless there is unobstructed pavement at least eight feet wide to the right of the vehicle being passed.
10.72.040 Riding on motorcycles.
A. Operators of, and passengers on, motorcycles are required to ride astride only, and only upon the permanent regular seat or saddle.
B. The operator must not permit more than one other person to ride as a passenger and must not permit a passenger to ride unless the motorcycle is designed to carry two people.
C. A seat designed for a passenger must be equipped with permanent hand grips, and motorcycles designed to carry two persons must also be equipped with an adjustable foot rest for the passenger.
D. No passenger may ride on a motorcycle in front of the operator.
E. A sidecar may be attached to a motorcycle in which additional persons may ride.
10.72.050 Riders’ equipment.
Motorcycle operators and passengers must wear protective headgear and must be protected by glasses, goggles or a transparent shield. Such headgear and other protective equipment must be of a type approved by the State Department of Public Safety. Protective headgear must bear a permanent distinguishing mark or stamp of approval to indicate it meets minimum standards.
10.72.060 Handlebars.
No motorcycle may be operated with handlebars rising more than fifteen inches in height above the level of the seat.
10.72.070 Brakes.
Motorcycles must be equipped with a brake with two separate means of application on at least one wheel.
10.72.080 Rear-view mirrors.
Motorcycles must be equipped with rear-view mirrors which reflect a view for at least two hundred feet.
10.72.090 Lighted lamps.
Every motorcycle when used on the public ways of the village must, during the period from sunset to sunrise, or at any other time when visibility is so limited as to require the use of lights for safety, carry and exhibit one lighted lamp commonly known as a driving lamp and affixed to the front of the motorcycle, showing white light or lights of a yellow or amber tint, visible at least five hundred feet in the direction toward which such motorcycle is proceeding. Also during such period all motorcycles must exhibit at least one lighted lamp mounted on the rear of the motorcycle and showing a red light visible for at least five hundred feet to the rear.
