2.220.010 Creation, purpose, and powers.

(A) There is hereby created the Commission on Food Security (hereafter “Commission”).

(B) The purpose of the Commission is to address issues concerning food security in the City of Evansville (the “City”) by making nonbinding recommendations to City government, not-for-profits, or interested agencies and by coordinating services, funding, and programs related to food security in the City.

(C) The Commission shall have the powers designated in EMC 2.220.050. [Ord. G-2021-1 § 1, passed 1-26-21.]

2.220.020 Membership.

(A) The Commission shall consist of not more than 30 members and shall include the following members:

(1) The Mayor of the City of Evansville.

(2) A City Council member selected by the City Council of the City of Evansville.

(3) A representative appointed by Tri-State Food Bank.

(4) A representative appointed by the Evansville-Vanderburgh School Corporation Superintendent.

(5) A representative appointed by Welborn Baptist Foundation.

(6) A representative appointed by Healthy Communities Partnership.

(7) A representative appointed by Urban Seeds.

(8) A representative appointed by Southwestern Indiana Regional Council on Aging (“SWIRCA”).

(9) A representative appointed by Community Action Program of Evansville (“CAPE”).

(10) A representative appointed by Aurora.

(11) A person appointed by the Mayor of the City of Evansville whose profession is in finance, banking, accounting, or a related industry.

(12) A person appointed by the Mayor of the City of Evansville whose profession is in the food retail industry.

(13) A person appointed by the Mayor of the City of Evansville representing a restaurant or the food service industry.

(14) A person appointed by the Mayor of the City of Evansville whose profession involves administration of SNAP, WIC, or other benefits from the State of Indiana or U.S. Department of Agriculture.

(15) A person appointed by the Commission who meets the Asset Limited, Income Constrained, Employed (“ALICE”) threshold or low-income threshold.

(16) A person appointed by the Commission who works or volunteers at an organization or agency that distributes food to the community, such as a pantry, soup kitchen, church, ministry, or homeless shelter.

(17) A person appointed by the Mayor of the City of Evansville representing a Feed America designated food pantry in the Evansville area.

(18) A representative appointed by ECHO Community Healthcare.

(19) A representative appointed by the YMCA of Southwestern Indiana.

(20) A representative appointed by the Pigeon Township Trustees.

(21) Any additional members as deemed necessary and prudent by the Commission, provided the total number of Commission members shall not be more than 30 members.

(B) Elected officials serve during their terms of office, and appointed persons serve for terms of two years subject to the pleasure of the appointing authority.

(C) Members shall serve without compensation.

(D) The appointing official, body, or entity shall fill any membership vacancy as soon as reasonably possible. [Ord. G-2021-7 § 1, passed 4-13-21; Ord. G-2021-1 § 1, passed 1-26-21.]

2.220.030 Officers.

(A) The Commission shall have a president, vice-president, and treasurer.

(B) The Mayor shall serve as president for the first year, and the City Councilperson member shall serve as vice-president. The offices of president and vice-president shall alternate between the Mayor and City Councilperson member each year thereafter.

(C) The president shall preside at all meetings of the Commission. The vice-president shall preside in the president’s absence.

(D) The treasurer shall be the member of the Commission appointed by the Mayor whose profession is in finance, banking, accounting, or a related industry. [Ord. G-2021-1 § 1, passed 1-26-21.]

2.220.040 Meetings and committees.

(A) The Commission shall meet at least once annually.

(B) A meeting quorum exists when more than 50 percent of all currently appointed members of the Commission are present. Quorum is required for the Commission to take any action during a meeting.

(C) Members of the Commission may designate a person as proxy to serve and vote in the member’s place if the member is not available to attend a meeting.

(D) If a member or the member’s designated proxy fails to attend three or more meetings in a calendar year, then the Commission may remove the member.

(E) Meetings shall be subject to the Open Door Law of the State of Indiana.

(F) Committees and subcommittees of the Commission may be developed to focus on specific issues. Committees should report their findings and recommendations to the Commission at least twice each year. [Ord. G-2021-1 § 1, passed 1-26-21.]

2.220.050 Commission powers.

(A) Financing. The Commission may direct the City Controller to establish a restricted donation account to enable it to accept charitable donations to the Commission. The Commission may use funds in the restricted donation account to administer and facilitate the Commission and its purpose.

(B) Staff. The Commission may hire staff to assist in the administration and facilitation of the Commission’s purpose. Commission staff may be compensated, at a rate determined by the Commission, from the Commission’s restricted donation account. Commission staff are not employees of the City.

(C) Property. The Commission may own, acquire, sell, and lease any real property or personal property used to serve the Commission’s purpose. The Commission shall use funds from its restricted donation account to acquire or lease such property and shall deposit the proceeds form any sale of Commission property into the restricted donation account for future use by the Commission.

(D) General. The Commission may otherwise generally make and enter into contracts for the facilitation and administration of the Commission and its purpose; provided, that all contracts made or entered into by the Commission must first be approved by the City’s Board of Public Works.
