11.30.010 Establishment. Revised 12/24

(A) In order to provide ways and means to carry out and support the scheduling and execution of special events in the town, the Town of Highland Community Beer Garden is authorized to fix and adopt from time to time a schedule of fees, charges and percentages to be paid by certain beer vendors who are participants in special events that are conducted by the town of Highland, and that are not otherwise under the direction of the Highland parks and recreation department.

(B) These fees, charges and percentages may be fixed for but not limited to special events at which the beer vendors participated as an amenity or attraction associated with a special event that is sponsored by the town of Highland.

(C) The town of Highland special events for which these fees, charges and percentages apply may be effective for special events that may be conducted from time to time on property of the parks and recreation department, provided the park and recreation board has authorized the use of its property for that purpose.

(D) All fees, charges and percentages charged by the Town of Highland Beer Garden shall be adopted at a regular or special meeting and be memorialized in the meeting memorandum of the town council at which the fees, charges and percentages were adopted.

(E) Vendors that participate in events under the direction of the town of Highland are exempt from the requirements of Chapter 5.35 HMC regulating peddlers and solicitors. [Ord. 1782 § 2, 2023].

11.30.020 Cash book duties – Deposit of fees. Revised 12/24

(A) Money procured from fees, charges and percentages identified in this chapter shall be deposited at least weekly, and more frequently when possible, with the clerk-treasurer.

(B) The clerk-treasurer shall deposit the fees and receipt to the credit of the special events nonreverting operating fund as described in HMC 11.15.050.

(C) The clerk-treasurer shall keep such accounts and perform such other tasks and duties outlined under IC 5-13-5 and 36-5-6. [Ord. 1782 § 3, 2023].
