GENERAL PROVISIONS

71.01 COMPLIANCE WITH SIGNS, MARKINGS.

All parking within the city shall be in compliance with all signs, markings, and the like as established by the Street Department.

71.02 PARKING WITHIN PAVEMENT MARKINGS.

Wherever the Common Council has caused the pavement to be marked designating spaces for parking vehicles, it shall be the duty of all operators of vehicles to park such vehicles wholly within the pavement markings designating where and how the same shall be parked.

71.03 PARKING MORE THAN 12 HOURS PROHIBITED.

It shall be unlawful for any person to park a vehicle within the street pavement for longer than 12 hours at any 1 time. This section is not to be construed as prohibiting overnight parking in front of a residence.

71.04 PARKING ON TERRACE PROHIBITED.

No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic or to avoid conflict with law or the directions of a police officer or traffic control device, on any terrace of the city. For purposes of this section, the term TERRACE shall mean that area located between any public street, road or highway and any public sidewalk running generally parallel with and adjacent to such public street, road or highway.

71.05 LOADING ZONES.

When the signs are erected prohibiting parking at spaces indicating that such space is to be used for a loading zone at that particular place, no person shall stop, stand or park a vehicle at any such designated place, except for loading or unloading of merchandise during the hours prohibited by such appropriate signs.

71.06 PARKING DURING SNOW EMERGENCY.

(A) Immediately following the declaration of a snow emergency by the Mayor or in his absence from the city, the President Pro-Tem of the Common Council, no parking shall be allowed on any odd-numbered side of any city street on any odd-numbered day of the month, and no parking shall be allowed on any even-numbered side of any city street on any even numbered day of the month until such time as said snow emergency is declared over, which declaration shall be made by either the Mayor or in his absence from the city, the President Pro-Tem of the Common Council.

(B) For purposes of this section, ODD-NUMBERED DAY or EVEN-NUMBERED DAY shall refer to that calendar day ending at 11:59 p.m. immediately preceding the restricted parking hours.

71.07 USE OF PARKING SPACES BY MOTOR VEHICLE DEALERS PROHIBITED.

It shall be unlawful for any dealer in vehicles or other person to park a vehicle not in use anywhere on the streets and alleys of the city. Such vehicles shall be properly garaged and not permitted to use the spaces provided for parking on the streets of the city.

71.08 RESPONSIBILITY OF OWNER OF VEHICLE.

No person shall allow, permit or suffer any vehicle registered in his name to stand or park in any street in this city in violation of any of the provisions of this code or other ordinances of this city regulating the standing or parking of vehicles.

71.09 OBSTRUCTIVE VEHICLE MAY BE IMPOUNDED.

No person shall stand or park his registered vehicle in any street in the city in violation of any of the provisions of this code or other ordinances of this city regulating a person’s standing or parking of his registered vehicle. If a person attempts to or does congest, obstruct or unduly restrict a free, clear and unimpeded movement of traffic by parking, unparking, stopping, standing or driving his registered vehicle or if a person should fail to remove his registered vehicle from any street or alley within the city within a 12-hour period after the declaration of a snow emergency by the Mayor and State Superintendent in order to facilitate snow removal, then the enforcement officer having jurisdiction may exercise his discretion to remove the vehicle when the driver refuses to move it or when the vehicle is unattended to such place, property or destination remote from such traffic movement and thereby impounded until such time as the registered owner thereof shall claim the same by the full payment of costs accrued for towing, storage while so impounded, court costs and fines assessed.

71.10 NO PARKING IN DOWNTOWN AREA DURING CERTAIN TIMES; REMOVAL OF VEHICLE FOR VIOLATION.

(A) With the exception of any motor vehicle with a valid handicapped license plate, or other handicapped indication, there shall be no parking of motor vehicles between the hours of 2:00 a.m. and 6:00 a.m., on every Friday of the calendar year in the downtown area designated as follows: the downtown area in which parking is prohibited between 2:00 a.m. and 6:00 a.m. shall have as its boundaries the east side of Water Street, from LaPorte Street to Adams Street, the north side of Adams Street from Water Street to Center Street, the west side of Center Street from Adams Street to LaPorte Street, and the south side of LaPorte Street from Center Street to Water Street, and all other streets bound within those parameters.

(B) In addition to the prohibition from motor vehicle parking on Friday of every calendar week as referred to in division (A) above, there shall be no parking from 2:00 a.m. to 6:00 a.m. Monday through and including Friday, of each calendar week during the months of December, January, February, and March. The prohibition from parking any motor vehicles under this division (B) shall pertain to the area referred to in division (A) as referred to above.

(C) Any motor vehicle found to be in violation of this parking prohibition within the designated area and during the designated times and days shall be subject to removal by a reputable towing company upon the order of a Plymouth police officer. Said vehicle shall remain impounded until such time as the registered owner of said vehicle shall claim the same by the full payment of costs accrued for towing and the storage while so impounded.

(D) Notwithstanding the penalty provisions of § 71.99, the registered owner of a vehicle found in violation of this section shall be subjected to a fine of $25. Said fine shall be subject to the jurisdiction of the Ordinance Violations Bureau pursuant to § 33.113.

71.11 ON-STREET PARKING IN JACKSON HEIGHTS SUBDIVISION.

(A) There shall be no on-street parking of motor vehicles on either side of the following streets located in the Jackson Heights Subdivision:

(1) Jackson Heights Street;

(2) Lemler Lane;

(3) Colony Court;

(4) Loon Court; and

(5) That part of Bayless Street located within Jackson Heights Subdivision.

(B) Any motor vehicle found to be in violation of this section may, upon the order of a police officer, be impounded, towed, and stored pursuant to the provisions of § 71.09, and all costs associated with the impoundment, towing, and storage of any motor vehicle found to be in violation of this section shall be paid by the registered owner of said motor vehicle.

71.12 HEAVY TRUCK PARKING.

(A) It shall be unlawful for any person to park a semitrailer anywhere in any residential zone as designated by the zoning ordinances and city map. This prohibition shall not apply to the parking or standing of a semitrailer for the purpose of making pick-ups or deliveries from or to any building or structure located within such residential zone, or for the purpose of delivering materials to be used in the repair, alteration, remodeling or construction of any such building or structure for which a building permit has been obtained. This prohibition shall apply not only on public streets but also on private property, including driveways and parking areas.

(B) It shall be unlawful for any person to park a semitractor or other truck exceeding 5 tons on a public street in any residential zone, as designated by the zoning ordinance and city map. This prohibition shall not apply to the parking or standing of such a vehicle for the purpose of making pick-ups or deliveries from or to any building or structure located within such residential zone, or for the purpose of delivering materials to be used in the repair, alteration, remodeling or construction of any such building or structure for which a building permit has been obtained. The prohibition shall not apply to any semitractor or truck exceeding 5 tons parked upon private property on a properly improved driveway or parking lot.

(C) It shall be unlawful for the operator of any semitractor or other truck exceeding 5 tons to permit said vehicle to idle in a residential area for a period greater than 15 minutes.

71.13 NO PARKING IN A DIRECTION OPPOSITE THE FLOW OF TRAFFIC.

(A) No vehicle shall be parked with the left side of such vehicle next to the curb.

(B) It shall be unlawful to park any vehicle in a street other than parallel with the curb and with the 2 right wheels of the vehicle within 18 inches of the regularly established curb line, except that upon those streets that have been marked for angle parking, vehicles shall be parked at the angle to the curb indicated by such marks.

(C) The fact that an automobile which is parked in violation of this section is registered in the name of a person or persons shall be considered prima facie proof that the registered owner was in control of the automobile at the time of the illegal parking. This presumption is rebuttable.

71.14 REGULATION OF USE OF PARKING SPACES DESIGNATED FOR ELECTRIC VEHICLE CHARGING

(A) It shall be unlawful to park any nonelectric vehicle in a parking space designated for electric vehicle charging.

(B) It shall be unlawful for an electric vehicle to occupy a parking space designated for electric vehicle charging unless the vehicle is engaged in the charging process.

71.15 FEE FOR USE OF CITY-OWNED ELECTRIC VEHICLE CHARGING STATIONS

(A) Use of all city-owned electric vehicle charging stations is subject to a flat hourly rate of $2 per hour.

(B) The city’s electric vehicle charging station located on Water Street near River Park Square was obtained, in part, through grant funding from the Indiana Department of Environmental Management under VW Project Funding Agreement Number VWL2-027. As a condition of the city’s application for receipt of such grant funds the city agreed to provide the first 2 hours of charging at the grant-funded charging station at no cost to users for the first 2 years after its installation. The grant-funded charging station is to be installed by no later than December 31, 2022. Thus, notwithstanding subsection (A) of this section, the city’s electric vehicle charging station located on Water Street near River Park Square shall provide the first 2 hours of charging at no cost through December 31, 2024.

SELF-SERVICE LOTS

71.30 DESIGNATED SELF-SERVICE LOTS.

Between the hours of 9:00 a.m. and 6:00 p.m. on Monday through Friday, inclusive, and on Saturdays between the hours of 9:00 a.m. and 9:00 p.m., the off-street parking lot situated on the northwest corner of Center and Washington Streets, hereinafter referred to as the North Center Street Parking Lot, and the off-street parking lot situated south of West LaPorte Street on South Center Street, hereinafter referred to as the South Center Street Parking Lot, and all other off-street parking lots which may be established or operated on land leased or owned by the city shall become self-service parking lots.

71.31 TIME LIMIT.

It shall be unlawful to park any vehicle on any self-service parking lot for a period of more than 1 day at any 1 time.

71.99 PENALTY.

(A) Any parking time limit violation under this chapter or the parking schedules set forth in Chapter 72 shall result in a fine of $5.00, if the fine is paid within 24 hours, which fine may be deposited at the Clerk-Treasurer’s office, including the night depository. If not paid within 24 hours, the fine shall automatically increase to $10. If not paid within 72 hours, the fine shall automatically increase to $25. For a second violation within 30 days of the first offense, the fine shall be $25. For a third or subsequent offense within 30 days, the fine shall be $100.

(B) If any owner of a motor vehicle has at least 2 unpaid tickets for violation of any parking regulations of this City Code at the time he is issued his next ticket for a parking violation, his offending motor vehicle shall be subject to removal by a reputable towing company upon order of a Plymouth police officer. Said vehicle shall remain impounded until such time as the registered owner of said vehicle shall claim the same by the full payment of all unpaid parking tickets, costs accrued for towing, and the storage while so impounded.

(C) Any fines for parking violations assessed under this section shall be subject to the jurisdiction of the Ordinance Violations Bureau pursuant to § 33.113.
